I wondered if anyone can advise me on the 40 days the bank is allowed. Does it go from the day you sent the letter or from when they recieve it? and is it a straight 40 days from there or is it 40 working days? Also I have sent my first letter to my local branch, does this matter?
Would be gratful if anyone can help.

i have just started the process of recovering my charges. i took the 40 days from the date of my letter. if you have had a ny letters from debt collectors or any bills, they more often then not state from the date of the letter. So why can't we do the same.

Fair point, just don't want to contact them too early and make it look like I don't know what i'm doing, coz in all fairness I don't.

I went through the process- and won in two cases - and from my experience it took them always that few days longer. But you have to bear with them. They are very busy trying to sort it out and knowing that they are on the losing side, so have a little patience- but no more than an extra week.

I counted it from the day I posted the letter- always recorded delivery so you have proof!

The local branch is fine as they will be passing it on to the right department. When in doubt just call them and ask nicely- usually they are willing to give numbers and addresses.
