County court letter from 'Private parking invoice' issued in March

Hello All,
A friend visiting our flat was issued with an invoice for parking without a permit back in March. After the initial anger I found this forum and we decided to take the militant approach and ignore them. The letters quickly stopped.

Now the new rules are introduced and all of a sudden a letter last month and now a county court claim hot on it's heals. Obviously we don't have too much time to reply. She is not too worried about the letters or the county court claim but we're not sure what we should do now. What happens if we dispute the full amount? I presume we'll automatically need some legal help? Does anyone have any suggestions?

Many thanks for reading this and any advice offered! If you need the last letter or the letter from the county court just let me know and I'll figure out how to pass it on.

    Show a pic of the County Court claim on a new thread on pepipoo - but only once you have phoned the Court to check it is a real claim. Some PPCs issue fake Court papers. And the new law is NOT retrospective, how could it be? It doesn't apply to your fake PCN.

    You can post your pics straight up on pepipoo (see their FAQs 'how to post pictures') whereas you can't here, and they have more legal experts over there. You do NOT need a solicitor for a small claim defence as you cannot claim your costs back except £50 or so (unless your house contents/buildings insurance or other policy includes 'legal cover' then you can get free representation). Pepipoo will help if none of your policies have legal cover to help out.

    Ok who issued the claim?

    Is it genuine?. Is it an actual claim form?

    Can you check it online, via the money claimonline service?

    If genuine, then do an acknowledgement of service and ask for 28 days extra to do defence. This is very easy

    Then get over to pepipoo and ask the experts on there who will sort a defence out for you. Loom on pepipoo for users wageslave and alexis. Send them a private message..

    You wont need a solicitor for this.

    What ever you do don't worry just follow the advice given:). Oh and the new legislation has nothing to do with this
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

    The "new rules" in force now are irrelevant to this incident from last March.

    Follow the advice already given, verify the claim is genuine then off to pepipoo if it is.

    Just to let anyone interested know. The claim was dropped. I've left a longer post on the pepipoo forum but can't post a link here as I'm a new user. The gist of it is District Enforcement [text deleted by MSE Forum Team] hadn't checked anything like leaseholder claims over the parking space etc. They forked out money for the claim and then had to drop it. :T

    If you you want to have some fun with them, why don't you sue them for trespass, as in this successful case:-

    We pressed on with our county court Claim against UK Parking control Limited
    ( UKPC ) in the Winchester County Court.
    On 21.1.2013 UKPC in an Order by consent gave undertakings to the Court not to enter our land and not to place any parking charge Notices on our cars and the Court ordered:
    1. Judgement for the Claimants ( ourselves )
    2. Damages for trespass in a total of £150.00
    3. UKPC to pay our costs in the sum of £ 1280.26 ( now paid )

    Made my afternoon. Thanks.

    However, just a little concerned about the £150 for trespass. It is covered a little on page 2 of the link provided, but as on the link thread, it is more likely to be used against the motorist than the PPC.

    OK - the landowner is the one who can issue trespass procedings, but somewhere in the back of my memory I thought that trespass in itself didn't expose the trespasser to monetary penalty.

    But apart from that, still got a smile on my face re the general article.
