Is this blackberry app legal?

DD has a blackberry and just said she has downloaded the TopMusic app which allows her to download music for free.

I have checked and it is an app in the blackberry store, is it legal to use?

The app itself will be legal, downloading copyrighted music from it probably isn't

Isn't is just licence free stuff, the wife got it and said there was nothing worth downloading?
