Car insurance cancelled without notice

Hi all,

My car insurance company left me uninsured for a week due to (their) administrative error. I didn't receive notification that the insurance had been cancelled and so I drove for a week without any insurance.

Would the Financial Ombudsman compensate me for this or does the insurance company get away with it scot free seeing as I was not caught by the police or fined?

Seems a bit silly if there are no negative consequences for the insurance company?

Thanks,

S

But there were no negative consequences for you either. Compensation isn't paid out for what could have happened only for what has happened and normally where you have suffered a loss which again you haven't

You have not suffered any loss, so what grounds will you use to ask for compensation?

On a practical note, have they reinstated it, or do you now have a cancelled policy on your record?
  • How did this happen please?
  • Ditto the above - compensation requirement implies personal loss.
    What did you lose?

If you require the insurance company to be investigated, in order that personal loss doesn't happen to someone else - due to their possible future negligence (based on the fact that they have been negligent) - that's different.

    Contact the ombudsman?

  • Do not contact the FOS - that is not the correct process and until people start realising that running to the FOS at the first sniff of a problem is incorrect, then no-one gets anywhere.

There is a standard (industry wide) complaints procedure and this is that you contact the company concerned and you lodge a complaint with the company. They should acknowledge the complaint in 5 working days - they then have 8 weeks to resolve the complaint and if after the 8 weeks there is no final response you can then approach the FOS - or if you receive a final response and you are not happy with the outcome you then have 6 months from the date of the Final Response to lodge the complaint with the FOS. The FOS will not look at complaints prior to this - all they will do if forward it back to the company concerned. At this point the 8 weeks start so start with the original company.
