UKPC parking and debt collectors

Hi all,
I have read through some of the threads and get the gist of not to pay unfair charges etc, here's the situ,
the other half was driving his mothers motability car and got a ticket on a retail park. After looking at all this advice we told her about it and advised that because she wasn't driver she could just ignore it. We've since replied to UKPC with the templates off Martins site and are currently up to the point debt recovery control have sent 3rd letter stating not to pay attention to forums/sites etc. Also that they are offering a reduced payment to £120. If they don't receive a reply within 14 days the matter will be passed to solicitors.
I know that they are simply scaremongering but the mum in law is panicking as she is worried about being taken to court. I have tried to reassure her this won't happen but she's a worrier! Also she 's grieving for the loss of a family member and i'd like to try to explain what might happen next so that she has some reassurance that this isn't as threatening as it sounds.

In this circumstance, one needs assuring how they come to be on the safe side. Firstly, explain to your mother-in-law that you are not applying tricks, this is not an evasion tactic. She needs to realise that private enterprises are not the law, they are not an authority and that despite their attempts at appearing official, they remain scam mongers that victimise weak targets.
Contract Law enables a landowner to push for losses resulting from a motorist's action. So if he parks without buying a valid ticket which would have been £1 for the hour he parked, then £1 is the proven loss. The demand for £50 is a de facto penalty and citizens are forbidden from penalising each other; therefore if the PPC believes your partner owes the sum in question, it will need to take the case to adjudication and satisfy a competent court that the amount sought is calculated losses only and not a penny for profit and you know as well as I know that this is impossible because it is not true, hence the reason they won't try. In the event they did try, your side would win hands down. A County Court resolves disputes between individuals, it would not be a case of appearing before magistrates and prosecuted for ignoring invoices which is what the elder member of the family seems to fear.
Explain this to her, that should bring back confidence.0 -

Offering a discount is always a sign that they are about to give up.
If they thought they had a case they would have gone to court for the full amount by now.0 -

Why doesn't your OH just respond and say he was driving so that they stop writing to her? He can also say that he won't be paying and that the charge is groundless, signage was rubbish, there was no loss, etc. We would recommend that informed posters here should always do that for a vulnerable family member from the word go - I would have done that even if I wasn't driving!
You say you have replied in her name using templates, I guess you mean the slightly silly and pointless ones that say 'I wasn't the driver'. They are several years old and we NEVER suggest using them, if you ask us on the live forum here. So send another useful letter, just ONE, that tells them who was driving, it doesn't incriminate him or anything, he's perfectly safe!
