Item Faulty - My options?

Hi,
I received an handheld console (Not too expensive) the end of last week from a seller. At the time it looked fine, turned on etc... but I didn't have any games to test it properly.
I did have a go on it yesterday and after a short time the screen started to flicker and change colour. making it impossible to use and obviously faulty. I have already left positive feedback when I was doing a load of others, I emailed the seller yesterday but haven't had a reply as yet.
What are my options now if the seller does not reply? Should I do a case on ebay? or would the fact I left feedback now mean I don't have much chance in getting a refund?

Feedback makes no difference to a case. I have started a claim today as the seller hadn't responded to my email. I would of waited longer but noticed he had been on to leave feedback for other people (they were different messages - so not automated) but didn't reply to me.
