The 164 page Judgment in the case of Parking Eye v Sommerfield also made clear that there is NO contract between the private parking company and the motorist. Sommerfield DID NOT appeal on this point.
VCS Ltd is altogether different because, the implications of the ruling from the Upper Tribunal is that VCS Ltd are liable to pay HMRC for VAT going back as far back as 2005. The amount payable ( plus penalties etc) could be staggering.....

I can't see them appealing on who can form a contract as its not the issue, what has that got to do with it ? This has got to be for the VAT IMO , and that is what interests the revenue, I can't see vcs winning this at all, these judges don't often judge against the vat manExcel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

There is nothing wrong in musing, idly, about the potential financial impact of the ruling(s) on VCS/Excel/SR-S but, as a careful perusal of the Tribunal judgments will reveal, VCS deposited sufficient monies with the court to cover their potential indebtedness. There will be no big hit in the future unless the Court of Appeal find some other avenue through which it might be extracted.
Counsel that represented VCS in the appeal to the Upper Tribunal is regarded as one of the country's leading lights in VAT matters. One wonders where else they have to go?
By the way I already have my seat booked.
