Full and Final Settlement with CCJ

Hi,

My partner has an outstanding debt with Debt Collection Agency STA Graydon for about £2k, for which she has a CCJ and has been paying this off at £50 a month for the past 18 months.

I have been reading lots of threads around "Full and Final Settlement" offers and wondered if it is worth trying to approach STA Graydon with an offer, as we are now in a position where we may be able to pay this debt off.

Full and Final Settlement offers seem hard at the best of times when re-payments are up to date, never mind when there is a CCJ enforcing the repayment.

I just wondered if anyone had had any luck doing this or had any advice.

    You might think that they shouldn't be open to a F&F when they have enforcement options. But in practice it's no different from any other debt. Follow National Debtline guidance and do it in writing first.

    Recently got a settlement on a debt with ccj at around 30%. I'm not sure whether the creditor had forgotten there was a ccj on it. Obviously we didn't highlight the fact but we did pay pretty quick as soon as we had the written confirmation in reply!

    Please read and understand it before offering. (The remainder of debts do sometimes come back to haunt people who do not tie the creditors down).

    Thanks for the reply, it sounds like its worth the try then.

    I would however be concerned about not mentioning the CCJ as part of my request would be for my partners credit record to be set as settled as opposed to partially settled, which they may not do if i am not concise in the F&F request.

    I spent the whole of last night digesting the website mentioned above which is very good. I will use the sample letter as the basis for my request.

    This is why i will be mentioning the CCJ in the F&F, as i would want to ensure the debt is fully settled and we had agreement for the CCJ to show fully settled and that there is no further outstanding comebacks from any creditors before any payment is made

    Started the ball rolling......

    I have just wrote a "Statement of Account" letter to be sent tomorrow. I thought it best i get them to tell me how much my partner owes first (I know the actual figure), just in case there are any discrepancies as they have not sent any further statements since the original court order requesting £50 installments.

    I think we just asked for 'an appropriate mark' to be made on the credit file. So that would be 'partially settled'. Frankly we didn't care too much about that side of things. The ND factsheet is also fairly vague:

    "I also request that, if accepted, you will make an entry on a credit reference agency file relating to the above account as having been paid and the account closed."

    I think you're unlikely to get a settled mark for other than 100% but let us know how you get on.

    I drafted my letter using the National Debtline template and i fully see where your coming from now.

    I have the exact same requests that you use in your letter which does not specifically mention a CCJ.

    I may need a new thread for the next question.....

    Is a partial settlement seen as worse than a full settlement on your credit record?
    I've searched on this topic and it appears to a real mixed bag of answers.
    I appreciate any CCJ is pretty poor for the credit rating full stop.

    If you insist they they mark it fully settled, they may well say no.

    I think insisting on your credit file being marked with a full settlement is not worth risking getting this debt paid and off your back.

    The difference between a CCJ on your file being marked settled or partial is tiny, compared to getting this debt sorted.
  • Hi yes i agree, i will be going with the standard national debtline template.

    I did some investigation into full and partial settlements this afternoon and it looks like we are only ever going to get a "patial settlement" status on the credit report.

    The important thing is the full and final settlement written agreement with the creditor.

    I'll let you know how we get on
