    So questions asked so far:

    1) [STRIKE]Bankruptcy fee [/STRIKE]- answered, possible fee waiver and charitable trusts to investigate

    2) [STRIKE]Getting made bankrupt versus doing it myself[/STRIKE] - answered. Take control.

    3) [STRIKE]Car [/STRIKE]- answered.

    4) [STRIKE]SOA [/STRIKE]- answered. Some figures need tweaking.

    5) [STRIKE]Cashminder account [/STRIKE]- answered. Paperwork being sent to me

    6) [STRIKE]Benefits [/STRIKE]- answered. Use lump sum payments to pay for bankruptcy fees, rather than wait until after bankruptcy.

    7) [STRIKE]Which debts?[/STRIKE] I am confused about the debts. Do all creditors pre bankruptcy ( other than non provable ones) get included, or only the ones you detail? I am 99% sure I have details of all debts I have, but if I forget one that reappears in 3 or 4 months time, do I need to ring the OR to include it or does it fall outside the bankruptcy and I need to pay it? - now answered.

    8) Student grants. I am looking at studying a degree after bankruptcy and there are several grants I am entitled to. Obviously I would declare these but does that open me up to an IPA? Does it matter if I get accepted onto the course before or after the bankruptcy date? Seems a lot of paperwork to do and I am not sure if it will take longer or shorter than my quest to raise £700?

    Hi..list those you know...any that subsequently come to light, simply inform the OR.....any that get forgotten? Well, that's the power of a Bankruptcy Petition, all unsecured debts are included [with certain, notable exceptions, of course].
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......
  • Thank you ! I wasnt sure if you were declared bankrupt and all fell under that umbrella ( well, apart from the exceptions!) or if it only applied to the ones you wrote down.

    Can anyone point me in the right direction for the query regarding the student grants please? I have found a lot about student loans but not very much about if student grants affect the bankruptcy or produce an IPA?

    I am sure there is stuff on here but I cant find it.

    Found lots of sample questions asked by the OR so I am preparing a list of information. I suffer with panic attacks and am so stressed out I am hoping to prepare as much information as possible in advance so I dont end up freaking out on the phone. I know I havent even handed in the forms yet, but I want to be prepared!

    In the same way that if your sole income is benefits you do not get an IPA, it's the same if your sole income is student finance whether that be loans or grants.

    Another question :( I am struggling to digest all the information and there are so many websites.

    1) I found this on another website. Is this true, because I know of 3 people who went bankrupt recently and their name appeared in the local paper?

    No, this requirement stopped in 2009 and the only time it will appear is if you are uncooperative, been dishonest and the OR feels that there is some merit in publishing this to get more information from creditors or about your conduct.




    2) Worst case scenario - imprisonment or BRU? Am I right in thinking all bankruptcies are agreed unless they consider you have not sought the correct advice or bankruptcy is not the best option? And that the worst case scenario is the OR putting in an additional BRU/BRO which could extend the bankruptcy up to 15 years?

    I cant see any reason for a BRU although my bipolar may indicate an overspending and gambling tendency, which I dont think caused the debts, but certainly contributed to the mounting debts. I can take full responsibility for each and every debt and give details behind them all, but just preparing myself for the worst case scenario. Is it a BRU or could it also entail a fine/prosecution?

  • Feeling at an all time low today. My battle to raise the court fee is just not working at all. Every time I get something set aside, I have to use it for other things. The benefit agencies keep asking for information, I send it, wait, then they request more. I went into one office with 20 documents, she chose to photocopy just one and then sent me a letter asking for the other information she had access to there and then. Pointless.

    Its just driving me absolutely mad and I am depressed and having panic attacks today. I am so desperate to make my application in December but I just cant see this happening at all.

    Anyone got any words of wisdom, jokes, pictures of dogs in sunglasses.....

  • Awww cheer up, sorry you feel that way, look just try to relax ( I know easy said than done) I am at the same point, trying to get the cash, and still waiting for my cashminder, it will be two weeks on Friday. I desperately want to get it done by December so I can start fresh next year but it just not happening. I will try my best if it does not, I just have to wait more I guess !

    Not sure if I can post this but even though it is extreme it made me laugh, I think I will have heart attack if it happens to me !

    Have you stopped paying your un-secured debts? this can be a help towards the fee?

    The benefits office can be a law unto themselves, best thing to do is make a nuisance of yourself to them, tends to chivy them along a bit!

    As for your previous questions, can't say for certain but IMHO considering your circumstances very unlikely to get BRU/BRO and even if you do its not he end of the world unless you want to start a company or become a MP etc! as for imprisonment I really wouldn't have thought so, but open prisons can be quite nice for a spell of R and R sometimes!

    Only know one bankruptcy joke....
