Seller doesn't refund items lost in post?

I want to bid on several items from one seller as the items are part of a split collection.
They have this on all of the auctions so I'm a bit wary of bidding.
I do not offer refunds for items lost in the post
I thought this wasn't allowed?
Their feedback is pretty good except for a few neutral comments from a few different users saying something along the line of wouldn't refund so had to go to ebay to get money back.
Would you avoid or risk it as don't ebay have to refund it if not?
I haven't had many items go missing in the post, at least not from ebay purchases but have from play.com so wondering whether it's worth the risk seeing that it can happen.

    if an item is lost it doesn't matter what the seller says- ebay will force him to refund.

    However, if possible it is worth trying to avoid these really stupid seller, so if the price is the same from another seller then buy elsewhere.

    I agree with Soolin, they may state that in the listing but they can't enforce it. If you didn't receive all you do is open a dispute, I would take a chance if its something you really want :)

  • Hi, thanks for the replies.

    It's a difficult choice but I really want to bid on at least 5 auctions as the items are from a split collection. It's sylvanian families toys which I collect and the various splits have all sorts of ones I've not seen before in great condition.

    Regardless of their T&C's they have to provide the goods and if lost in the post they have to refund. If you don't receive the items and they do not automatically refund then just open a dispute and unless they can provide tracking that says the item was delivered the case will be awarded in your favour.
