While on this subject, When I recieved my notice of transfer to my local court after Barclays defended my claim, I was not sent an allocation questionnaire, When I queried this with the court they told me that they didnt get sent out and I would hear about a court date shortly...... Does this sound right or should I be chasing......0

Quite common now, its to speed up the court process, have a read of these previous posts.0

Hi
I am claiming my Credit card charges back from Barclaycard
they have not given up the fight and the my claim has been passed to my local court.
I received a letter for Northampton county court explaining this but part of the letter has been crossed out with pen??
here is what the letter says
A defence has been filed
The Claim has been transferred to the court covering the area where the
[STRIKE] defendant[/STRIKE] (over written in pen) Claimant lives
[STRIKE] Please read the accompanying documents carefully and note that the allocation questionnaire should be returned to Chichester County Court.[/STRIKE]
Am I meant to receive a questionnaire to fill out? or is this only for the defendant to complete??
I think that they have just sent me a copy for my information but I just want to be sure and I don’t want to get this wrong and not be fully prepared for my court date.
so if anyone has an answer it would be really helpful
Thanks0 -
can anyone help? i have a claim ongoing against lloydstsb i have gone through all the template letters and mcol with the result of my claim having a defence filed claiming "service charge" are fair and reasonable and not unlawful. The allocation questionnaire has been dispensed with and i have just recieved a hearing date for the 6th june. I am a little concerned that i have not sent any documents to the court and not heard a thing from the bank or their solicitor. Is anyone in the same position as me? Am i supposed to take a bundle with me to the court hearing?0

A court bundle is normally required to send to the court and bank's solicitor at least 14 days before the hearing I believe. Have you been asked to produce/send anything with your court hearing letter? I'd give the court a ring and ask for advice as your hearing date is so near.
By the way, is highly probable your bank will settle before court and they won't turn up.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -
Received, notice of transfer of proceedings including lloyds defence notice. on the front page it says "please read accompanying documents carefully **and note that the allocation questionnaire should be returned to worthing county court**
** has been crossed out
There is no indication as to what happens next, just a copy of their defence. I received this morning a letter from worthing courts advising case has been forwarded to them and all further comms to go to them.
Should I just call them?0 -
I'm sorry I've got the same as everyone else what do I do reply to the request for further information and clarification..0

Hi, I apologise in advance if this question has been answered before, but I've spent a good half hour trudging through the jungle of messages and I can't seem to find one relating to these specific queries...
I have just received the letter entitled "Notice of Transfer of Proceedings". It says that it has been transferred to a court in London (fine for me) and to read the accompanying docs carefully. It does also say "the allocation questionnarie should be returned to.." but this is 'crossed out' in strikethrough text, so I'm presuming I've got to send some more information first.
The next page says "Without hearing...it is ordered that (1) the filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of Transfer orders otherwise".
I'm a bit unclear about what the purpose of this "allocation questionnaire" is. Does it replace some part of proceedings?
The next two pages are a copy of the printed defence from Barclays. Their defence has a lot of legalese in it defending their right to charge me, etc, but the first point says "The particulars of the claim do not provide details or particulars of the account in question and the precise charges alleged...the defendant puts the claimant to strict proof of each charge and the date thereof".
So presumably this means I need to send details of each charge to the court. Is it ok, in that case, to send a copy of the table of charges I copied from the charges-calculator on MSE? Does it matter that these include the interest, which isn't mentioned here? I am wary of sending too much or too little information in case the case gets thrown out as a result. Also, if I send charges, what kind of covering letter do I send? Is there a template for this anywhere on this site?
Finally, assuming this list and a covering letter is all I need to send off, what happens next? Do I get this questionnaire?
Very sorry for all the questions - hope these can be answered without taking up too much of someone's time!

Hi Stephen
All I can find referring to this stage of claiming on that thread is "When you issue a court claim, your bank has an opportunity to enter a defence. If they do, the court will write to tell you which court your case will be dealt in (if you claimed online), and they send you an Allocation Questionnaire to fill in"
I have no such questionnaire - just the letter as outlined above. I just need some help with the steps needed in this extra part.
