DLA Renewal

I won a tribunal last year for DLA and was awarded middle rate care from low rate care, since then ive had a carer move in with me as things got worse, i had to fill in a renewal form with the help from CAB as this runs out in feb, had the decision really quickly that from feb i will only get low rate care again, so now ill probably lose my severe disability premium and my carer will lose his carers allowance, also had ESA medical today bet ill be failed on that too

    Agree above.
    However, you not only need to appeal the DLA decision, you also need to get a copy of any evidence used for the DLA decision, as it may be used against you for ESA.
    Hopefully you can submit extra evidence of the DLA decisions inaccuracy, if appropriate, before the ESA decision is made.

    How are you getting the SDP when someone gets carers allowance for looking after you and you dont live alone?
  • I had my appeal decision today after a telephone conversation with DLA on thursday and i have been awarded middle care and low mobility for 5 years, never heard back from ESA medical decision even though they said 3 weeks, surely now ive won my DLA appeal i shouldnt even be in the WRAG

    DLA and ESA are not directly related.
    As an example, you can get DLA HRM for not having any legs, and be 'fit for work' under ESA.

    Some reasons for a DLA award may translate directly over to reasons for an ESA award of the support group.
    http://www.tameside.gov.uk/esa/lcwra - if the DLA award states any of these reasons indirectly, then send in this information to ESA urgently, so they have it before the decision.

    Phone them when they reopen, to ask them to delay the decision a few days, so that you can ensure it's taken into account.
  • This was the appeal which asks them to look at the decison again, if its still a no then it goes to the tribunal hearing

    The DWP may more frequently than they have in the past now contact claimants by phone.
    This is under programs similar to 'right first time' .
    This can happen at multiple stages through the claim.
    At least the initial decision to grant benefit, as well as at reconsideration.
    It it 'unfair' to claimants who can't answer the phone - yes.
    Is it better than not doing so - yes, for most claimants.
    Getting the decision right first time, fast will if not getting the claimant what they want all the time, at least give them an outcome.
