Assaulted at work

hello all, some advice please. do you think my employer has failed to protect my health and safety or has been negligent?
a couple of months ago i was assaulted by a patient at work, who was known to be very violent and had incidently assaulted other staff weeks before. no additional measures were put in place after my first assault and the patient about an hour later attacked me again punching me, he went on too threaten me later on again.
i was not spoken to about this incident/day by managment.

    need to provide a bit more info really. what type of establishment do you work in?

    by patient i assume you either mean hospital or care facility?
    Even a stopped clock tells the right time twice a day, and for once I'm inclined to believe Withnail is right. We are indeed drifting into the arena of the unwell.

    If the OP wants to take legal action (tone of original post suggests that) then consult a lawyer or at least the union.
  • yes im in a union and i have made a written statement, its not so much that i want to claim as i have been off work now some time and have developed mental heath problems due to this. i fear i will get the sack if i dont return and im not sure i can.

    Have you developed mental health problems as a result of being off work or because of the attacks and threats?

    But on the same score, doesn't the employer have a duty of care to employees to minimise the risk of such things happening?

    The trauma of the attacks can stay with you and probably will stay with you for the rest of your live to some degree, but your confidence in your ability of work in this environment has taken a big knock as well as far as I can see. That is a very very personal matter. Is there anyway of confronting that fear or talking about it to someone?
