Take to court or not? Advice please!

I am not claiming back years of charges from Nationwide (the rudest, meanest bank out there). They have charged me a few times for bounced direct debits. I was closing my a/c and changing my dd's to another bank a/c. My account with Nationwide is limited facility and not 'allowed' to be o/drawn so they bounced a couple. They've made charges and now interest, it now comes to over £140, which they have debited my account by. So even though I can't be overdrawn (!!) I now am. I cleared all my funds out before they charged me so they couldn't take it from me. I want to close this account but they won't let me until the balance is back to zero. Well I'm not putting any money in there!
I've written to them and said I will take them to the small claims court if they don't bring my balance back to zero so I can close this account.
Question is, do I need to take them to court to reclaim this money even though I've not paid it out as such? I assume I will need to as they don't seem to be doing anything and I've not yet had a reply to my letter saying I'll take them to court and more interest will probably accumulate.
Any advice from others would be much appreciated. Thank you.

    You can still reclaim the charges as you would if you were to receive cash. The only difference will be is that the account will be credited with the amount and brought back to zero. It is worth doing to save them chasing you for the 'debt' so good luck :)
  • Please continue with your dispute - there are a lot of us out here wishing you success. After 20+ years of good relationship with them I'm also having major hassles and will be glad to be rid of them. Think sometimes though it's just some of the individuals working for these establishments who are so inflexible, it's probably the only bit of power they have in their sad little lives.
