CCCS not able to help?
Options
Hi,
My brother is in an IVA with Freeman Jones. They are causing him serious headaches. He's in tears many days with the stress of it.
I advised that he approach the CCCS. However, they told him that because he was already in an IVA they could not assist him in any way. This seems contrary to the stick pasted on this very board:
"We, my wife and I, are on a seven-year plan with the CCCS, one having recently changed from a commercial debt management company after hearing Martin on Radio 2's Jeremy Vine show."
Can you switch to being dealt with by the CCCS or once he's with Freeman Jones does he have to stay with them? My brother's experience with the CCCS, and the sticky here, contradict one another.
Any clarification is appreciated.
My brother is dyslexic and could really do with somebody to sit down face to face and assist him. Any ideas?
Cheers

Hi BigLad, from the quote you have posted it seems that person is on a debt management plan rather than an IVA, a DMP is not legally binding so you can change any time you want. In your case if the IVA is in place then the CCCS wont interfere as the IVA is legally binding. If it got to the point where the IVA failed then im sure the CCCS would give them advice.
What sort of problems is he having, perhaps people on here can helpHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

Thanks for your reply.
They have increased his payments despite his salary going down. They lose information he mails to them yet won't allow him to e-mail information them.
Now they are insisting that he has to let them process his PPI claims so that they can get the best result. They state that if he tries to do it himself he'll be in contravention of his IVA. Of course, they want to charge him to do it ( £ 180-00 plus VAT).
They quote a nice little paragraph from his IVA agreement but I'm not sure it would hold up.
Cheers
