    and also is it percentage of the current value or of future value? If you're paying towards the mortgage or household expenses then you'd have a claim over any increase in value after the wedding should you divorce etc...

    I'm not sure whether the 'deal' is fair or not.

    However on the assumption that the 60% would be left to the children in his will, it is possible for him to state in a will that you can live in the house for as long as you like without the children being able to force the sale.

  • Agree with a previous poster you need to see a solicitor to get it worded correctly in your wills. obviously his 3 children should not be able to turf you out, however if they want to sell the house, then you are entitled to your 40%.

    My fil has mentioned something similar to what mountainofdebt has written in his will , his 2nd wife can stay in the marital home until the end of her days, even though it will be willed to his 2 sons. my dh & his brother cannot sell the house from under her, however if she were to remarry, the house is to be sold, she then gets a % of the sale.
