Ordered new bed, retailer now wants more money

My girlfriend and i ordered a new bed and mattress recently. The salesperson quited us a price, which included free delivery, we agreed and promptly placed an order and paid a deposit.

Today i receive a phone call from the salesperson saying that both items have arrived and when would we like delivery, but he went on to say, he made a mistake and the bed frame should be £100 more than we agreed on.

Now while trying to sort this out he has offered to compromise suggesting we pay £50 and he pays £50, which we dont agree with, where he promptly threatened to cancel the order, at which point i saw that the invoice states all deposits are non refundable.

So my questions are;

1. Does he have to honour the price shown on the invoice

2. Can he cancel the order even though we have paid a deposit

3. What are our rights for getting our deposit back if HE cancels the order not us

    1. No he doesn't if its an error - I would bet it covers for this in the small print somewhere - even if it just has a tiny 'E&OE' mentioned somewhere (Errors and Omissions Excepted)

    2. yes he can, the deposit locks you in, not the seller.

    3. Yes if they try to charge more than you agreed then they must either meet the terms or fully refund as its their breach of agreement.

    Make one final attempt - firmly say you will only pay the agreed price and are ready to accept delivery, ask if he is refusing to supply the goods - if so demand your payment back.
