Dodgy seller on Play.com

I bought a DVD listed as very good from a seller on Play.com. When it arrived it's case had puncture marks all along the spine. It was tatty and obviously not caused in transit. I emailed the seller twice with no response. I have opened up a play trade case via Play and again the seller hasn't responded.
My question is why are businesses acting so recklessly when times are quite lean and businesses are fighting for customers ? I have looked at the seller's feedback and it is peppered with similar cases to myself. Surely they will be banned if they carry on ? I have no idea what will happen but they are blatantly ignoring complaints and when my case has run it's course, what then ?

There have been bad companies probably all throughout history. If a company are only interested in your money and not in your custom (there is a difference) then nothing is going to change that. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0

Surely enough bad feedback will be detrimental ? You can't get away with bad service for ever.0

This makes it all the more important to check who you're dealing with before parting with your money. The signs were there in the feedback as you say.
In my experience play will just refund your money and only suspend the trader if/when their losses exceed their income from him.0 -
Playtrade have refunded me the amount. Will this be passed on to the seller ?0

I bought a Windows XP installation disk via Play.com (Playtrade) back in January 2009. It now turns out (just this weekend) that the disc was not genuine and so Microsoft have blocked my product key!
I have contacted Play and asked for a refund under their PlayTrade guarantee. Do you think I will get anywhere with this refund after buying it 4 years ago?0 -
if not joy from Play, i would name and shame them (and the seller) on twitter..Long time away from MSE, been dealing real life stuff..
Sometimes seen lurking on the compers forum :-)0
