Landlords

Hi I privately rent my bungalow - I am going to declare myself bankrupt as soon as I can save the fees, my question is does my landlord have to know about the bankruptcy, as I am scared she will not renew the tenancy when it's due if she finds out and then myself and my daughter will be out on the streets literally HELP

    No, you dont have to tell her (unless its in the contract that you do).

    The only problem you may have is if later on you decide to move and credit checks are done and it will be picked up that you are (or have been) bankrupt.

    When you change your bank account , from which you make your rent payments, all you do have is tell her you have decided to change banks.

    Of course you can tell her if you want, but you dont have to.

    Sometimes the OR does inform the landlord, mine did.

    However if you have always paid your rent on time and are keeping the house all up together and have a good relationship with your LL, then I would very much doubt there would be any problems with renewing a lease.

  • My OR didnt tell my landlord - I gave her a copy of my agreed shorthold tenancy agreement and that was enough :)

    No idea why my OR contacted mine, I only knew as they contacted me to check I was still here as the OR had given them an incorrect current address! My original OR wasn't er that er nice I have to say. Fortunately I've been passed to another who is.

  • Thanks everyone lets hope the OR doesn't then I pay cash to her each month so my bank account doesn't matter in regards to the standing order and changing bank accounts, I have my tenancy agreement and it doesn't say anything in that so will take that with me. Thanks again

    Hi Larz and welcome.

    It is literally the luck of the draw. I know a couple of people who went bankrupt and the OR didn't inform the landlord, but with me they did. (and with a couple on this thread.) Although I have to say that it was the property agent that was informed and not the landlady herself - so she still doesn't know. :p I doubt she would care though tbh.

    Me and my hubby sought out property agents when we were thinking of going bankrupt (we were homeowners and had a mortgage,) and we needed to go into private let. We let them know we were going to go bankrupt a month or so after moving in, but assured them we would pay the rent OK, as we have paid our mortgage for 18 years, and paid rent for 3 or 4 years before that! We really struggled and had a dozen doors slammed in our face, but a couple of agents were OK, and when they did credit checks, we came up OK. :)

    Anyway, I am rabbiting on... Upshot is: the OR *may* let you landlord know, but he/she would be very foolish to let a perfectly good tenant go, who is paying the rent on time and looking after the property. (I am presuming you fit this profile. :) )

    Some landlords may be reluctant to rent to bankrupts, but I would suspect that if you are an existing tenant, and have been for a while (say over a year,) and you have been a good tenant; the vast majority of landlords would not make you leave. What would they gain from it?

    I wouldn't worry. We need to move to another property in the spring as the rent is high on this house and our income is dropping when our daughter hits 18 and leaves full time education, and our property agent has already announced they will be more than happy to help us find somewhere else. They know we are good tenants who pay our rent a week early all the time and look after this property well. :)
  • Hi thanks for the reply myself and my daughter have been in the property now 18 months never been late on the rent and she recently did an inspection which was fine and extended the lease to July next year so if she did find out and decides she wants me out how much notice do I get?? I pay 575 a month will the OR think this is too high and make me move to a cheaper place - can they do that?

    If you've been there more than six months your tenancy is renewed automatically by the mere fact of you paying the rent.
