I received an item which was hopelessly packaged and arrived broken.
The seller said he would refund me the same day when I contacted him.
Im still waiting 7 or 8 days later .I opened a case ,his latest email
is saying I have to close the case before Paypal will let him pay.
Is this correct?
I find ebay extremely convoluted to deal with this ,I do not know the ins and outs.

No, I'm pretty sure he can close the case himself by refunding. I would say I'll be happy to close it after you've refunded me.0

Whilst I can't say I'm an expert as I've never had to deal with a case, but from what I understand, from previous topics on here, is under no circumstances close the case as you won't be able to open another one. AFAIK, your seller is talking rubbish about not being able to refund until the case is closed. He's just doing this so that you close the case and then he won't have to refund.
Have you returned the item? If not, then Paypal will ask that you do. Send it tracked and then enter the tracking details into the case and Paypal will then refund you.
Should also add, that you mustn't threaten him with negative feedback if he doesn't refund you as that will be grounds for him to have it removed if you do decide to leave a negative. Also, don't mention the dispute in the negative feedback as this will also allow him to get it removed.0 -
Definitely do not close the case! That will let him off the hook without his refunding you and you can't open a case twice... I believe the case closes automatically once he has refunded.0

Thanks for the help.The item was so inadequately packaged it was a
complete joke why he even bothered sending like that, it arrived totally in bits.Ive submitted photos he should give me a complete refund, for the money involved if I have to send this back it will be a will not be worth it financially.0 -
Happened to me last week. Seller 'forgot' to charge postage and wanted me to pay - erm NO!
Then he ordered a courier but didn't have a printer - courier refused to take it.
Then it arrived, after two weeks loose in its original display box. When i told him the heavy electical item was broken - he said "it can't be its not even fragile" :rotfl:
He refused to refund without speaking to Ebay - then refunded after about a week. I was patient though - as he was clearly an idiot. The reason i didn't aswell - is i was hoping not to have to return it - would have cost around £9 - and seller did not ask for it back (i had sent pics showing it was smashed up).
Don't close case - tell him it closes itself on refunding.0 -
I've actually come across this situation as a seller: Paypal would not immediately allow the refund because the funds were frozen until eBay reviewed the case, but after a couple of days the refund went through. You could try explaining to the seller that the refund should be authorised soon, and there is no need for you to close the case. As others have advised, you should not close the case because you would then have no comeback if the seller failed to refund.0
