Received an empty box from Ebay seller

I recently purchased bold 9900 on ebay but there was no phone inside the box when the parcel arrived through royal mail special delivery. There were headphones,bb original box, leaflets and tray only and a small note saying “White blackberry bold 9900 numbers under battery 0168”. The box was wrapped in light brown paper with special delivery label on the box. The contents of the box shouldn’t have been less than 450 grams but the parcel I have received only weighs 150 grams. I requested royal mail receipt from the seller which will show item weight when it was put on their scale. I immediately opened paypal claim upon receiving the empty box therefore the seller says lets wait for paypal findings and will not be responding to me.

I have been buying these items for resale for the last couple of years and this is the first time I have received an empty package! PayPal has received response from the seller and they are investigating it. Will paypal be requesting post office receipt from the seller in order to make a decision because I didn’t say anything about weight of the item when I made the claim.

    It could be a simple mistake his end. Don't fret yet. Who knows, he could have had it ready to go and then his kid took it out the box and he didn't recheck. Maybe ask him if something like this could have happened.
    I expect you will be asked to send back with proof postage and refunded. I find paypal disputes better than ebay ones.paypal should refund once item shows it has been returned. You will be out of pocket with postage though.

  • Auction picture clearly showed Sealed white pouch,battery,usb cable, battery, phone sitting int the tray and adapter. Didn't show headphones but they were sent.

    Auction was defintely for a phone and everything was clearly mentioned.

    Seller only responded once to my emails saying

    "As you are aware this matter is being investigated by Paypal and we await their findings.
    Any comments on this matter should be directed to paypal and not to us. We will not be responding to any more of your emails"

    That is a worry. They are either guilty or suspect you are a dodgy buyer. Hopeful paypal gets it right and you get the refund.

    Look for the phone for sale on a webiste that shows the weight of the product. You may be able to use that to show what the box should have weighed.

    Site like Amazon often have the gross weight listed.

    I sent an item to Argentina that has goods stolen in transit. Fortunately - Argentina post recorded the weight of it at arrival at the post office - 1.3 kg less than when i posted it - so i won my claim with royal mail.

    have you got a link to the add? really sounds like you was bidding on an empty box thats why the seller has said what he said.

    seen some very good worded adds on ebay for empty boxes that could easily be mistaken that it includes a phone.

    Agree - op describes the pictures. But its the wording we want to see.
  • HERE IS AN UPDATE

    I wrote to the seller:

    "Hi,

    Paypal have asked me to report the incident to the police and get a crime reference number. Police have asked me to get the IMEI of the phone from seller so they can register it as stolen goods

    Please let me have the imei of the phone as soon as possible.

    Thank you for your co-operation"

    Police not contacted yet but I wanted to see which imei he is gonna provide. Box imei was checkmend clear though! Paypal don't even care about the weight on the receipt so never requested that from seller.

    Seller replied today saying

    "I can not apologise enough. I fully understand that you will find this hard to believe. I have the phone in front of me having found this at home. Clearly a blackberry box has been sent probably for my old blackberry .
    I had contacted our local police to ask them to look into the matter but have now told them to take no further action. I have also contacted paypal who will refund you your money.
    I guess it is up to you what you want to do . If by any chance you still want this phone please let me know.
    Once again my sincere apologies"

    I still think he tried it but failed because i had extracted his full details (company etc..) from google to be reported.

    I am getting my money so end of story!

    Something along the lines of - "Seller sent an empty box. Refund achieved through a third party." or similar.
