Ebay removed item for copyright breach - now buyer opens case

Too early in the morning for me to work this one out ! - any help appreciated ( obviously after the 2 minute silence ) - Ebay pulled an item I had listed before it ended (I thought ) on a MC019 copyright ruling ( someone had complained about the use of trade mark name within the listing )
Ebay sent me an email stating that all bidders had been informed that it had been removed and my listing fees were returned
I don`t check my Paypal payments individually ,so didnt notice that a buyer had sent a payment ,My Ebay states that I have no items to send ?? - now the buyer has opened a case against e for non delivery ( had no communication from them prior to this )
I can email buyer thru his email address in paypal statement - but what do I tell them ?

Just refund the payment and the case will be closed. Ebay pulling it does not mean don't send it - you would have had an email from paypal saying they paid.
Ask them if they want it or a refund.
They can't leave you feedback for it - so no worries there.0 -

If they opened a case personally I would refund, it could get messy (unless it's something that would be sent with tracking meeting PP's criteria anyway).0
