I don't live in an idealistic world but i do work for a bank and have worked for Natwest. I currently deal with cases exactly the same as yours, people who incur large amounts of charges and then blame the banks for their mismanagement. There are genuine cases of hardship and these are dealt with sympathetically by banks, IF it truly is hardship. A bank would never pass on a debt to a DCA without contacting their customer first, there are procedures that have to be followed before this can be done. If customers ignore any attempts to contact them, then they really have no cause for complaint when the debt becomes due.
When you closed your account 6 years ago, owing 6k, what did you think was going to happen ? What were the "issues" you had with Natwest ? The answer to this question is important, the FOS will contact Natwest for their side of the story. If you knew about this debt, why haven't you done something about it in the last 6 years ? It seems to me that you may have been hoping it would be written off, you can't just walk away from 6k worth of debt. If someone owed you 6k what would you do ?
Screaming and shouting about this isn't going to get you anywhere, with anyone. You need to take action now, do what you should have done 6 years ago.
I appreciate that you don't like my comments but the way i read it, you've been happy to wait for the last 6 years and not do anything, and now that the !!!! has hit the fan, you blame everyone but yourself.

Who said I closed the account 6 years ago? They get something in their mind and base a whole case on it. I left the bank about 1 year ago and the case has been with the FOS since then.
I downloaded the last 6 years bank statements which is a completely different thing.

I stand by my comments, it's irrelevant really when the account was closed. 6 years worth of charges, did you never query them ? Now you think there's a slight chance you'll get them back you're complaining ? How can you not know that you've paid 8k in charges ? You need to take a look at your own book keeping.0 -

Well if you think charging someone - who has already told them that they have financial difficulty - 1300 pounds in one month of charges from a 2k salary is legal and fair then you are deluded too. Mind you, I suppose you all pee in the same pot if you are a FSA.
A real solicitor has told me that I stand a very good chance of being recompensed for some of the astronomical charges.
I'll take his advice for now thanks and I am going to ignore your trollish comments so please do not answer this thread further as you are offering no advice - be it financial or otherwise.0 -

What advice did Natwest give you when you told them you were in financial difficulty ? It's not illegal for a bank to apply charges to your account by the way.
How will you feel if your "refund" doesn't cover your solicitors bill ? You'll probably be better off negotiating with Natwest or their solicitors to get the amount you owe reduced as a full and final settlement. Did your solicitor advise you to try this ? Probably not. Then make an arrangement to repay them. But as you seem hell bent on getting 8k back (the chance of that is nil) i'll leave you to it.0 -

The solicitor is a friend who is advising but not representing.
Yes the Natwest have written to me lately (Via the solicitor)since I defended my claim with the courts and have offered the fees to be reduced to half. Obviously this letter will be coming to court with me as no such reduction has been offered before.
And I assumed (incorrectly it would appear) that as you are a financial advisor you would be affiliated to some body. If not the FSA I asume similar.
It is my right as a British Citizen to defend something I believe is unjust and unfair. I know that you are only defending the banks and cannot comprehend that this could happen but I assure you it has. Those friendly banks you defend do actually make mistakes and this is one such occasion.0 -
Apart from taking longer to look into your complaint, which you were compensated for, what other mistakes have Natwest made ? Applying fees to your account isn't a mistake. What part of BCOBS is your friend referring to ?
You may feel that the charges were unfair but the courts looked into this and decided in favour of the banks. As they've now made an offer to reduce the fees, it would be in your best interest really to seriously consider accepting this. If Natwest haven't made any errors in applying the fees and you refuse their full and final offer of a reduction, it may cost you more in the long run.
As for not comprehending that this could happen, i see this every single day at work. I also speak to people who are in dire straits but take responsibility for their finances, and seek help before the situation gets out of hand. This is what you should have done, to pay such a high amount in fees is not the banks fault and could easily have been avoided.0
