advice please, house purchased with issues..

Hi
To cut a long story short, i bought a house which i thought had tanked cellars, which were written on the estate agent brochure as "tanked cellars" with a "games room & Built in office room".
I have now found out that it is not tanked....and is leaking?
where do i stand as i have a huge bill to correct this. my solicitor thinks that it is my responsibility to track down the sellers which i think is nearly impossible

Did you have a survey prior to purchase? If so, what type?
Who was the seller? An individual? A company?

Do you need this hassle when u r pregnant? If you have one buyer lined up, you can get another one (and having a buyer lined up is still no guarantee the sale will go through). Plus u'll have to live with roof work etc in late stages of pregnancy/early after birth. Last thing u need.
Think about it., you have over four years to find another house, possibly a better one, in the catchment area u want for schools (assuming u don't have other children, I am thinking in terms of when u need to be in an area with a good catchment area). I'd suggest if u have managed so far with the property you are in, u can manage a bit longer.
I realise you want a certain area with a certain catchment area.., but are there no other good school area's within a few miles? London does have other area's that may be comparable, and travel is usually pretty easy with the tube if u want to be close to work.
You might be better looking at other areas. Even if you are unfamiliar with said other area's. I am certain they exist.

It's a Victorian terrace 1890. Yes I had a full survey done.
The cellar was an individual not a company.
I don't think there is any come back on the surveyor. I was just wondering if the estate agents had any responsibilities, as it was clearly stated that the cellar was tanked.

Other than the leak, how do you know that it isn't tanked? It might just have failed locally.
You wont have a claim against the EA. It's up to you to verify what they say to your own satisfaction.0 -

Why didn't this come up on your full structural survey? Re-read your report and then contact your surveyor to re-inspect. Don't trust a damp company salesman, get an independent damp specialist in to report.
Estate agents are supposed to be honest but they are only as reliable as the information they are given by the vendor and they are generally unqualified, you are expected to have your own surveys and reports done to confirm the condition of the property. I think the EA would be liable under the Property Misdiscriptions Act. They cannot say something that they have not had confirmed, i.e. double glazing/damp proofing etc..NOT a NEWBIE!
