    Oooooo .... not necessarily. It could be that the posts were changed over with the (then) owners' agreement at some point in the past. So you can't rely on this as being incontrovertible "proof" of ownership and/or obligation to maintain. Sorry :(

    When we got a 6ft fence put up in the back, we were told to put the posts in our property as we were buying it and since the next door were council we didn't have to ask them which I thought was terrible (council said this) so we did ask and they were ok with it (well they were getting one side of new fence)...so what you're saying is if we sold...who would own that one side of fence? I can see how that would cause problems down the line right enough...thanks xxx

    D F C is correct !

    One of the properties I own, the neighbours are replacing their fence with new panels and posts but, they have erected the posts on my side, and butted the panels together on their side, probably because the fence will look better from their side. It's on the boundry, it will always be their fence !

    For boundarys and fences in general....

    In short the fence belongs to whoever paid for it.

    your deeds will probably state which boundary/fence is yours, but that it not necessarily the case if the fence was not paid for by you.

    You are able to errect a fence along any boundary. as another poster has pointed out. This is useful in hiding less courteous neighbours unsightly constructions.

    Be warned that painting, treating, hanging trellis or growing plants to that cause damage to your side of your neighbours fence can be constituted as criminal damage.
