Parking eye

Recently had two run ins with parking eye trying to claim money from me amounting to over £200 in total.
The first was for parking on Aldi store longer than one and half hours, the second parking in fun park in Lake District( just waiting to pick up family members)without ticket.
On both occasions I appealed and failed and had my fine increased.
So I contacted the owners of the car parks, explained why I hadnt complied with parking restrictions, and that I would be taking the cases to court and would require the attendance of their employees to verify what I was saying in court.
Guess what? instant phone call to parking eye from the owners cancelling the fines.
The owners were supportive of Parking eye but not to the point of it costing them money.
I know the advice is to ignore but I was curious to push my case further to see what would happen.

and that I would be taking the cases to court

    On what basis ?

For a parking charge they take you to court (or not in 99.9999999999999999999% of cases)

Doesn't look like he actually needed a basis :-)

Seems like the threat of court worked just fine! Amusing to use the same tactics as the PPCs back at them. (they don't like it up 'em!)

Quite so but I am still intrigued as to what the OPs response would be if the landowners had said "whatever see you in court then"..what is his basis for any action ?

Reading the post again, perhaps he meant that he would be requiring the PPC take the case to court if they actually wanted any money out of him, and that if they did he would call employees as witnesses.

Which under the Civil Procedure Rules for a Small Claim at County Court you can't do.

    (1) The general rule is that any fact which needs to be proved by the evidence of witnesses is to be proved –
    (a) at trial, by their oral evidence given in public; and

    (b) at any other hearing, by their evidence in writing.
  • Thanks for the feedback.
    Some interesting stuff there.
But basically on speaking to the actual owners of the car parks, and leaving them in no doubt I would be contesting any court case, and, calling their staff as witnesses, they quickly folded.
I wasnt aware of all the legal niceties, just that I wanted to fight my case and drag them into it as well.

A jolly wheeze indeed ,but so much easier to just ignore them ....
  • Yes, but it gave me a sense of wellbeing to have beaten their system.
I was pretty mad at the injustice of it all and to just ignore wouldnt have satiated my desire for vengeance.
    Sleeping easy again now.
