You start the 6years on the day that you send the letter asking back for charges.

Great, thanks. That'll only affect one of my charges. Can anyone else help with my other queries please?

    Many thanks!

OK, I've got a replies from all the banks in question, a few have said they will get back to me before the end of the month (MBNA related cards), a few have given refunds and one hasn’t. But I think getting back charges and interest on these charges is a complete myth! All the banks disagree the charges are unlawful and none of them are willing to give a penny of interest on any charges:

Capital One: They have reduced my £20 charges to £12 so I have been given a refund of £20 on my card (which is currently empty and I'm in credit so will have to somewhere get that £20 off them).

Morgan Stanley: I need to write back to them to confirm a refund of £8 (again bringing one of my charges down from £20 to £12.

Egg: I've got £48 from each of my cards, no interest again. I'm just about to send a reply in writing to confirm this and will get these refunds paid into my current account. Egg are different to all other banks so far, they are only bringing their charges down to £16 and not £12, is this right??

Barclaycard: They disagree "with my legal analysis". But "as a goodwill and without any admission of liability" they are prepared to credit my account. So I can get a refund of £8. Again, my account is closed and so will write back with my bank details to get paid into my current account.

Alliance & Leicester: Really disappointed here, these are the guys who've charged me the most. They say that the OFT consider levels of late payments to be unfair on credit card fees and NOT bank fees. Is this correct?? They do not feel I've been unfairly charged and cannot refund me! Can I do anything about this?

It seems the banks are only giving out refunds as a gesture of "goodwill" and one or two of them say the ruling does not apply retrospective!

You'll find links to all the bank main threads in the Reclaim Help Thread which is linked in my signature.

None of the banks will pay you interest, or indeed are obliged to pay you the interest as this is something that is awarded by the courts should your case go to court.

Please read Martin's article and listen to the audio link regarding the interest in the article.
