Sorry to hear of your loss. It must be gut wrenching to get this news from the insurance after your tragedy.
I am not siding with the insurers (I hate the lot) but insurers are a business too and have to make a profit. They have professionals paid to take a dispassionate view of their losses (sadly your house and life turned upside down for them is a technicality). It is in their commercial interest to find any loophole they can hope to exploit to save them from paying out.
This is where you need to carefully but forcefully stick to your guns. Use the media. They love these kinds of stories. Threaten to go to BBC Watchdog. They will relent and pay up. Make sure you end up with a no-fault claim at the end of this or your premiums will skyrocket.
I am very sorry to have to suggest some sensationalism but the means surely justify the end. Sadly there is no law that covers how insurers must operate so you need to let public opinion be your jury.
I am a business owner and we had our airconditioning units vandalised for copper last year costing us best part of £22,000. Insurers wouldnt pay out saying that the units were outside the building and where covered though the policy noted the presence of aircon. Doh. Took come carefully placed calls and they relented.

We know we don't need a solicitor to go to the ombudsman but we are using her so we get everything right first time. I would like to get a positive end at that stage rather than drag it through court. We will go to court, we will take it all the way as its so unfair but the quicker it is resolved the better.
I have to say I don't like the idea of going to the papers etc as I see this often and the 'bad' side just put forward their case and thats the end of that. I've sat here myself thinking how unfair some people are treated but it doesn't seem to change what happens?0 -

I understand that you don't want to go to the papers as you don't want the publicity, but I really would contact Jessica at the Telegraph as everything is done annonymously - only your initials are shown in the paper and she really does have a lot of success.0 -

When it was our house that burnt down, the Fire Investigators told us to bin all electrical items for exactly the reasons given by tlh in his/her excellent post number 21.
What I did find incredibly useful and effective in cleaning up all those bits and pieces that are not washable is to use good quality baby wipes. It stands to reason, really, when you recall the type of substances they are designed to deal with
