The FOS will not interfere or rule on grounds of commerciality.
Common sense dictates that lenders will honour existing contractual arrangements but decline new applications. Particularly if the outcome is a straight loss.
I said I would not post addictive isn't it LOL. Yes your correct however commercial decision is one thing fraud is another. The motive the weapon I intend to get a conviction however large the organisation.0 -
If they wanted to remove you from the product you would have been offered a higher rate surely? Was it not the case that you were declined and left on the same rate and terms?
Genuis from the bank that. Committ fraud in order to leave you on the same loss making product.
I am now convinced this thread is a wind up.
If they offered me a higher rate they would be in breach of contract.

I'm unsure why you keep on harping about fraud. As you were party to the transaction. If you wish to end up on National Hunter database in the process. Then that's a matter for you to decide.0 -

Harping on about fraud, as lender cannot provide a signed document for a face to face regulated mortgage application and conducted a credit search with out having one, that is a breach of the data protection act, and furthermore as they then offered and conducted an appeal when they after having already conducted a previous application, credit search, and had it assessed by underwriting, a further breach of fsa rules.
Im not sure what the data base is you mention but the ICO can decide if conducting a credit search with credit ref agency with out disclosure from applicant is data breach then I will have to wait and see. manipulating a regulated process to cause financial loss to individual is fraud. fact.0 -
Hey Thrugelmir, just looked at site data base you mentioned, point number three there. says.... Anapplicant inflates their annual income to facilitate access to additional borrowing.
How does that work when i was trying to reduce existing borrowing. please explain. thank you

Potatoman, please prolong this fascinating thread (and start a few more if possible). It's riveting (albeit incessantly repetitive drivel) and sooooooooo disagree with whole "a little knowledge is dangerous" theory.Hi, we’ve had to remove your signature. And if I see any local banks under siege, with staff taken has hostages until one of them admits they have undertaken fraud I will be putting the Old Bill in the direction of this thread....!!
Take it up with them by all means, some of the rant actually has small pieces of merit.
The bank and probably the FOS will just put you down as a fanatic and try and get rid of you by paying you a small compo gesture.
You must be more cohesive and less dramatic/fanatic.
Oh and by the way, I am out now (for good)I am a Mortgage Broker
You should note that this site doesn't check my status as a Mortgage Broker, so you need to take my word for it.This signature is here as I follow MSE's Mortgage Adviser code of conduct. Any posts on here are for information and discussion purposes only and shouldn't be seen as financial advice.0 -

If the case was cohesive and not dramatic then I would be.
As for fanatic I'm a father of three one at uni the other two still in mainstream education, any one in my situation with half a brain cell would do what I've done. Its just that the lender / advisor figured id give up and had no idea i would uncover the application scam.
If you were to read the advisors case notes for this you'd be led to believe that I had contact with her just before xmas 2008 and then just turned up at branch on the 5th february and had a full blown credit checked application. she has not even mentioned the fact she issued a kfi on the 3rd feb, because thats when the application was conducted.
Yes its taken 3years to get all the documents the only one not supplied is the evidence for the lender that any application took place on the 5th feb.
Sorry to have lost you on this one mr dave ham.
must go I've got to fill some forms out with action fraud, thanks thruglemir, and you still not replied to my post on fraud data base.0 -
