    You may well have to attend. Basically all the court want to do is decide upon the issues that need deciding in the claim, and whether to allocate your claim to small claims or upwards to fast track.

    I think you will probably receive settlement prior to the hearing. The courts seem to order these as a way of getting an earlier court date, as Allocation hearings only last 5 mins or so rather than 3 hours for a full hearing.

    What did you write on your allocation questionnaire (assuming you had one)

    also have you a copy of the defendants allocation questionnaire ?

    sometimes they ask to involve expert witnesses etc so the judge may want to discuss this with them.

    If you can type out the full order you received from the court with the date on that will help. I'll look in a bit later see if you reply.

    Hi Kevwev just read your thread, i would take the advice given and go and look on the 'Consumer Action Group' site they have lots of info on what you need to take etc, but from the sounds of it the court is only decided where to file the claim ie.probably small claims track like mine. You probably won't be there long so i wouldn't worry. If you are still concerned why not give the actual court a ring and ask them!!! Hope thats of some help. Suz

    thanks yeah i know i will be there like 5 mins but just wanted to know what do I bring or say etc? have no idea you see :o

    Thanks for all your support. Just got home. Had to wait 2 hours before it was my turn was only in with the judge for 5 minutes who basically said abbey have agreed to pay in full :beer:
    I will recieve a cheque within 28 days. Didn't have to show any documents at all .

    :j Seems that they are more interested in trying to frighten you out of claiming than anyhting else.

    well done. One thing - when cases are listed together, it doesn't mean you all go in together. Its a block listing. Basically operates on a first come first served basis - whoever gets their first and says to the Clerk that they are ready gets on first.

    Remember days as a junior solicitor getting there a bit late and having to wait for 3 hours before my 3 minute hearing...
