Moving early

I thought it was the case that if a landlord asks me to pay my rent until the end of my contract (we are moving early) then they could not re let it or even let anyone live in it for free as I will have paid the rent.

Whats the law ?
Could anyone clear this up for me please.

    It's worth running an advanced search, this issue comes up regularly. No the landlord cannot charge two lots of rent at once, you should only be paying for an empty property.

    This is true. The LL cannot be receiving 2 lots of rent.

    The way forward is to negotiate with your LL.

    He may be willing for you to pay until he relets it or allow you to cover the costs of advertising etc for a new tenant.

    He may be keen to come to some sort of arrangement as if the property is left empty for some time then it may invalidate his insurance.

    The OP suggests the LL wants to let someone live there for free. So no 'double rent' involved.

    However, the answer is the same.

    If the tenancy has not ended, then only the tenant can visit/live go in (unless he gives permission).

    The tenancy can only end
    a) when the fixed term ends or
    b) if the tenant and LL agree an Early Surrender (in which case rent would not be payable)
  • So if someone was to let a landlord use a secured deposit to cover their 30 day notice period can they not move a new tenant in during this time?

    This has happened to me and my family last month, the LL moved new tenants in 4 days after we left, so we are now contesting him claiming all of our deposit as he should only require a weeks worth of money.

    He didnt allow us access to the house for our mail as we had to give our keys back when we moved and couldnt get it anyway as the strange tenants he moved in wouldnt give us the post they had for us and where shouting out of the window to see the LL!

    He now will not budge on taking the full rent amount and will only allow us £25 back, even though he had received rent from them 4 days after we left.

    I dont think this is right but he will not enter into a dispute with the deposit scheme. What can i do?

    If you have paid the rent until say the end of the month then you have the right to decide who uses the property until then.
