Home insurance problem - who should pay?

Hi All,

In the last couple of weeks I have noticed that I have some staining on my kitchen ceiling and called out a plumber who found that my shower tray has been leaking.

I should point out that I changed insurers at the end of September from Tesco to Axa.

Axa sent out an inspector who validated the claim but declined the claim because he said it was "pre-inception" and I would be covered by my previous Tesco policy. You guessed it....I have then spoken to Tesco who refused claim because by their policy you are covered from date of discovery!!!!!

Has anybody else come across this and any ideas of who should be responsible and how I now progress my claim???

  • Its a little unclear from your post how long it was from inception of the new policy the issue was found.

    Check your policy wording however with Tesco as reading the wording on their site for Standard cover incepting Pre Aug 2012 it states that the loss must occur during the policy period not that it must be discovered during the policy period
  • Thanks for the reply, so my Tesco policy expired on 29th September and Axa started up same time. So I was about a month into new policy when issue was found.

    where did you find that detail on the Tesco policy, would you happen to have a link to that by chance?

    Home insurance is written on a 'claims occurred' basis. It is the policy in force when the claim occurred that is relevant - not when it is discovered.

    The difficulty you have is proving when it occurred. Can you pinpoint a day that you first noticed it? I would imagine the staining would happen fairly quickly after the leak started.

    It sounds to me that this is for Axa to deal.
