Incorrect Parking Ticket

My sister got a parking ticket in Newlyn Car Park issued by MBC Parking Solutions Ltd. She parked there overnight. The board displays a charge of £5 for 24 hours which she paid and got a ticket. She did not notice that the ticket was incorrect. It clearly shows a fee of £5 and an issue time of 22:10 BUT an expiry time of 10:10, which is only 12 hours.
She appealed and they rejected it quoting 'Photographic evidence' and 'Expired Ticket' !!!! with the usual threats about Debt collection and CCJ. She sent copies of the ticket and the charge display.
As she was going off to New Zealand for 6 months a week after receiving the rejection she paid. I said I would look it.
Does anybody have any knowledge if this can be further appealed and has anybody had a similar experience in this car park.
I feel that this is a fraudulant ticket and comes under fraud laws.

If she's paid, then that's the end of it.
Shame really, you are correct in that it was a fraudulent ticket, and she legally didn't owe them a penny, regardless of the signs.

I fear she has lost that money now.
Why on earth did she pay them?
She had already paid for 24 hour so she owed them nothing.
Maybe chalk this up as a lesson learnt and ignore all PPCs in the future ,and spread the word to friends , family ect.0 -

Not only should she never have paid but she shouldn't have appealed. If she had wanted to write to them it need only have been to reject the unlawful demand as she was issued a de facto penalty and not a bill for losses resulting from the action. Now given she bought a ticket and there was a malfunction, they would have had no leg to stand on in court. Usually they have one broken leg (ie. they lose) but they'd have been going down had they tried.
Furthermore, did she really think she'd be extradited from New Zealand??0 -

She shouldn't have paid. Why did she do that????? It's a well known scam and you/your sister only had to ask here or Google it.
You have zero chance of getting a refund so just learn about this scam now you are here. EVERY thread on this board tells you to ignore these.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As I expalined, she paid because she was going to be out of the country for 6 months in a few days and did not want any hassle of dealing with legal stuff from the other side of the planet. Does anyone know how one could have dealt with this situation.:)0 -
Well thanks for all the replies. It is as I suspected. You may be surprised but a lot of people do not know of sites like this. I only found it by googling 'parking fines' This was of course after my sister told me of the appeal rejection with 1 week till she was leaving the country. Reading a lot of this site it seems to me that the police are not doing their job. All it should take is one complaint of a fraudulent operation and an immediate investigation and prosecution. Trading standards should be threatening these companies and shutting them down, AS they do with other frauds. A few of those actions in national news and the whole country would know what to do. It should not be up to the victim to deal with it.

If its fraudulent is it not possible to take them to court for refund and costs.0 -
You could try, but I don't think they'd pay you back, they'd probably just live with the CCJ you'd get against them. And then you'd be even more down on the deal because you'd have paid the court fees.

I am sorry but you have missed the point. 'Fraud'? 'Police'? This is nothing to do with the Police. Trading Standards rarely care about it either.
We never said the tickets/invoices were fraudulent - they are not (usually!) - and we have already explained how she should have dealt with the scam. She should have ignored it, why on earth respond to a fake parking ticket? It didn't come from the Council or Police so what on earth made it worth replying to, let alone actually falling for the whole thing and paying it?
And we know most people don't come on forums but for goodness' sake, you don't need to know about a particular forum to suss a scam. If it smells like a rat it probably is one - it's just that these private parking companies (PPCs on here) stay within the law because they don't actually call it a penalty. These are just speculative invoices aimed at the most unwary or uninformed members of the public. They are unenforceable twaddle (but not fraud).
A Google search of the company name would have shown you various results telling you clearly that it's not a fine at all and should have been ignored like a tiresome series of phishing emails. Anyway hopefully none of your family will fall for a fake PCN again.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
