Unfair Default

Hi,
Please can someone help me.

I took a loan out in 2006, unfortunately lost my job & missed payments. Understandably a default was placed on my credit report for 6 yrs.
I consulted a debt management company to help ( bad move ) so since November 2006 I have not missed a payment.
In June of this year I had saved some money and wanted to pay my debts off in full. I terminated the contract with the debt management company and called all creditors.
All but one settled and are now clear, however welcome finance have given me nothing but problems.
For a start I still have not had a final statement, they are not recognising my final payment, even though I have it shown on my bank statement, and they say the debt was taken out in 2007 not 2006.
As a result of all the correspondence being ignored and the information they have being wrong , I now have another default - so 12 yrs in total for one debt !!
I am not avoiding the debt , I wasnt to give them the whole outstanding amount , everytime I call I am accused of lying and they try to tie me into setting up another direct debit.
I am at the end of my tether with this and feel very wronged by them. Do I have a case to have the default removed, as this is not a true reflection of my credit history.

    When is the default date showing on your Experian, Equifax and Call Credit reports?

    Yes, if there is an error on the date you can challenge and you have clearly been trying to settle...

  • Its only showing on Experian, and the default is listed as August , this is the second default on the same debt. Im so upset as I have been on the phone with my card in my hand begging to clear it , its like they want to tie me in further. Also they will not listen when I tell them the information is wrong

  • Yes Ive never missed a payment , I wrote and called them advising I was leaving the DMP aswell.
  • My last payment ( of which I have statements ) that I made to them upon cancelling the agreement has not been logged, and their records show the loan as being taken out in 2007 , which again is incorrect

    Not much argument they can put up. If you were making the payments as agreed.

    I would suggest you make a complaint through their complaints department and make sure you keep evidence of all correspondence with them, its easier when required to provide proofs.

    The reality of the world is that these debt management companies are there to just exploit people who are already in problems. Its worse then blackmailing!
  • It really is disgusting and Ive learnt a hard lesson.
    I will definitely fight it , and I also want to know where the payments I made from 2006 till Nov 2007 have gone, as thats when they have my contract date as starting.

    You can ask Experian to raise a dispute on your behalf with the lender. Quickest way to do this is using our online query form. Defaults should only ever be recorded once.

  • I am still no further with this atrocious company.
    The financial ombudsman are dealing with it, but I understand they are busy and this takes time.
    To add insult to injury they are continuing the fun and games. I have sent a cheque for £10 and the SAR request. First they tried saying they dont have records of my name and required proof. This is laughable in itself, so another call was put in and they confirmed yet another mistake, as they have all my name details correct.
    Secondly, the cheque was cashed on 14th December. Guess what, now they have failed to comply within 40 days they are claiming that they never had the cheque !!! How can this company even be trading.
    Can anyone point me in the right direction, I have got my bank statement and copy of the cheque from the bank as proof. But I am sick of dealing with that circus.
