IVA Completed PPI claim..
Options
Hi
I wonder if someone can help. My mum had an IVA which she finhsed on 3rd August. She hasnt got her certificate of completion yet. During the IVA the company made PPI claims and used them to pay off some of the debt,
Now the IVA has finished she has made a PPI claim against a loan which was NOT involved in the IVA and was fully repaid. She has been awarded £16500 but they are saying they will send the money to Debt Free Direct to offset against the IVA.
This does seem unfair as she has completed the iVA and the loan wasn't part of her debt and hd been fully repaid 6 years ago.
Has she got any chance of getting some or all of the money?
Help!! Thanks

Very little chance as it is an asset in the IVA. Think of it as similar to her having 16500 sitting in the bank when she entered the IVA. Only 2 slim chances the first being to call on their good nature perhaps pointing out that you saved the creditors money by the IPnot nneeding to pay a claim company. The other depends on what percentage of the original debts in the IVA were paid backHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

Thank you. The Company who owe the PPI have told her not to sign anything and to phone the Ombusdman to ask advice. HE did say all is not lost if, like you say she can appeal to their better nature:rotfl::rotfl::rotfl::rotfl::rotfl:0
