Vanquis ROP

I know ROP isn't PPI but i was wondering about the mis-selling thing, long story but here goes! I had a Vanquis card up until last year. Like an idiot I took out ROP and all was well until I got into financial difficulty. To cut a long story short, account went over limit and with charges etc the balance climbed. Vanquis say that if your account is in good order you can use ROP, but mine wasn't, however this did not stop them continuing to collect ROP fees increasing my balance. I have 2 questions, (1)can they still charge me for a service I cannot use? and (2) when I had the phone call asking if I wanted to take up their ROP, if the operator did not inform me that they would continue to debit ROP if my account was overlimit, would that constitute mis-selling?

Any advice appreciated.:)

    I'd say both of these would have been very obviously written in the terms and conditions and you would have had a "cooling off" period in which to decide it wasn't for you.
    While it's necessary for the seller to tell you about the major exclusions of any insurance, it would not count as mis-selling if they didn't tell you about the consequences of not operating the account properly (i.e. going over your agreed limit).

    Thanks for the replys all, what I forgot to mention was that I asked them to cancel ROP @18 months before the account defaulted. In the original terms & conditions it stated "if your account was in good order" mine wasn't (this being due to increased outlay because of my oh's ill health). If you look at the t&c's it states "the cost of ROP will be taken from your available credit", if I was overdrawn, there wouldn't be any available credit. Time to SAR I think and see what comes back.
