    Help Please!!

    Hi,
    Found out yesterday i had 2 CCJ's one from 2011 and one from 2008

    Today i contacted the courts to get the information needed to pay them off
    2011 one no problem, rang done and their sending me the form to apply to the court for a satisfaction certificate. excellent.

    The 2008 one however i've had a right run around.
    Called the solicitors on the ccj they said they'd passed it back to next directory
    Rang Next directory to be told they'd passed it to Cabot
    Rang Cabot to be told they knew nothing about the ccj for this account but confirmed that it is the same account we were talking about and that they had passed it on to Robinson Way
    Rang Robinson way which confirmed they held the account and i paid it

    Now when i've looked on my credit file it seems that debt is listed twice, once with cabot and for the ccj
    Robinson way said they'll send me a reciept for the payment but nothing about getting rid of the ccj or a satisfaction certificate

    Cabot and Robinson knew nothing about a ccj being attached to this debt so what do i do now?
    I want the debt satisfied on my credit report, am trying to rent a house and they said they couldnt till the ccjs were cleared and that i had to get the certificates to show them then they'll rent to me

    Help please dont know what to do!!!

    Hi Ox,

    It would probably be easier if you could give your employer the new accounts details, if you get those details through before Tuesday. There's no guarantee that your money would be taken out of your old account if you got paid in there, but there is a possibility of this happening.

    If you have any other accounts with banks you don't owe money to, like an old savings account, you could use that as a one off then change to your new account for the following month.

    I'm not sure if you mean the new bank or your employer want to credit check you. If it's the bank then that won't affect your job. If it's your new employer it would depend on what they're looking for. If they're just checking you've got no bankruptcy or IVAs on your file then you should be fine.

    PPI often gets cancelled when you start missing payments, but you can cancel it yourself if it's something you don't want anymore and then you'll know it's definitively been stopped.

    Hi Bpdm,

    You can read a bit more about the difference between satisfied and unsatisfied debts here: http://www.trustonline.org.uk/understand-judgments-fines/certificate-of-satisfaction-satisfied-vs-unsatisfied-ccjs.

    The relevant bit from this page is:
    when the court are provided with evidence that a judgment debt has been paid in full, that court should notify us to amend the register and the register will show the entry as "satisfied". This will show anyone searching the register that you have paid, and when you did so.

    So my take on this would be that Northampton County Court can update Registry Trust to say this debt has been satisfied if you can give them evidence that the debt has been cleared.

    I'd guess that a closing statement from Robinson Way showing your payment should be enough - though you may also need to show evidence of the debt being transferred from the various different places to prove Robinson Way were handling that particular debt.

    All this may take some time, so it might be worth checking with the estate agent to see if there's other evidence you can show them instead of your credit report being updated to satisfied (like a statement showing the debt being paid off).

    Can I ask another piece of advice I am paying Aprils CC payments but hopefully my DMP payment will be taken on the 1st May if everything lines up. However in that case some payments to debt will already be overdue at the end of April and possibly even May ie not in a 28 day cycle if SC pays on the 25th. What should I do in this case, I could make token payments do they accept these directly and how do I pay them and also do I need to write to them over this. Or once i send the letter in the pack will I get some grace time so they SC DMP can be sorted. It all feels a bit complicated. It will be difficult to make the DMP payment and other payments out of 1 salary check
  • Hi I need some advice, in 2000 I had a barclaycard that I last paid in July 2001 it had a small outstanding balance around £50. I have never been contacted by Barclaycard to repay this debt.

    In January this year I applied for a new mortgage which was approved however a week later a default appeared on my credit file from Provident Financial who I have never had a loan with. I spoke to them and they confirmed that this was a debt they had brought from Barclaycard stated it was defaulted in February 2009 even though I haven't made a payment since 2001 which is an 8 year gap! However Provident are stating that as the default was in 2009 this is still within the six year period so they are within their rights to pursue the debt. Is the right??

    Last week my Mortage company re credit checked me due to an error on the paperwork and as a result of this new default on my credit file have withdraw the mortgage offer - I have appealed this and shown the letters I have already written to both Barclaycard and Provident but this has been rejected.

    How can I get this removed from my credit file and should the debt be statue barred as it is now 12 years from when I last paid. Interestingly my credit file stated a completely clear payment history with Barclaycard.

    Could someone give me some advice and it is something I need to do urgently as we were due to exchange contracts on our house move this week.

    Hi Ox,

    You don't need to make a payment to your creditors in May if you've made your first payment to us. If any creditors query this with you then you can just explain that you've started a DMP and their payment will be with them towards the end of the month.

    Also, you don't have to make the full payment in April if it's going to leave you stretched. We generally recommend advising your creditors of the DMP and making a one off gesture payment of whatever you can afford.

    I am about 4 years into my DMP with StepChange, I am still a long way off from paying the debt off, 55,000 approx still to pay, I have about 12 creditors and the biggest is a CCJ (never missed the CCJ), I am now in a 90 day consultation period and I will be made redundant at the end of June.

    My wife is just about to have an operation which means her salary will drop from 250 to 85 a week for at least 6 weeks.

    I still have a large mortgage and a secured loan against the house and the house is in negative equity if you count the secured loan.

    I will need my redundancy payment (25,000) to live off until I find a job (if I find a job).

    Can anyone please give me advice on what to do next?
