    I have asked my, so called creditors to show me the original credit agreements, signed by both parties. I have said I will travel anywhere to view the original agreements. I have also asked my creditors to show me some profit/loss accountancy showing they physically lent me some money, by moving money from their account, to my said account & that they have incurred a loss. As all businesses have to have accountancy. My creditors now no longer want to speak to me. Could you inform me why this is? I have disputed with all debt collectors, saying they won't answer my questions or show me, what I have asked. I now no longer get any calls from any debt collectors, could you tell me why this is? I have always said I am happy to pay them, on basis they show me these things? Why will they not do as I've asked? I would be grateful for any answers.

    Don't file for bankruptcy make payments, they legally have to except your payments, You cannot be taken to court for paying. Send them some money, any amount. They have to except it. They cannot refuse payment of any kind. You are offering REMEDY on the private side, they will be showing BAD FAITH by not excepting the REMEDY, however SMALL. Just try & pay something, anything & keep paying each week. I have to say this, is very wrong. Don't offer, just send a payment, however little. They can refuse an offer, they cannot refuse a payment. I hope this helps. All the best another debt slave.:sad::sad:

    Because you are playing them at there own game, that's why.
    DCA`s don't want you to know your rights, or what you can and cant request, or what they can and cant do.
    In reality a DCA will pursue you for a debt without providing one ounce of proof, unless you ask for it !!.
    Asking for a copy of your credit agreement should be made in the way of a formal CCA request, accompanied by the statutory payment of £1.
    Just asking for proof of the debt will cost you nothing, but don't expect your credit agreement.


    Basically if you are a thorn in the side of a DCA, they will just move on to someone who isn't, as they want a quick buck, that's probably why they have stopped contact with you, but fully expect it to be passed on to another DCA in the near future, and the game begins again..........

    I also like to ask them for the DEED of ASSIGNMENT & the DEED of NOVATION. Makes me chuckle every time LOL

    I knew all this, I was just wondering how many on here new lol. I play them constantly lol, I find it good fun. LOL. I always tell them to ask an honest question, is not a dishonest act lol. Cheers

Read a post saying SD passed to NDR (internal recovery), but F& F only likely when external recovery used. DMP likely almost 6 years, so would have been keen to try too complete earlier. Can't believe how apprehensive I am about DMP. Thanks.

    Its understandable that your going to be apprehensive, - your entering a new chapter, yes some uncertainly, there be a lot of questions, what ifs, will they do this or that, it sounds daft but its all part and parcel of the debt free journey.

    You've done the best thing, the one major difference between diy and having stepchange involved is the support, - you might not not see the support but a lot goes on behind the scenes, contacting creditors, - i got told by one of my creditors (I have 10 - varying from 8k loan to £150 store card), that I could supply the information such as budgets and offer of payment and stepchange could do the same, - they'd accept stepchange without any questions, but an individual they wouldn't be as accepting.

    There may be some late charges ad interest added on, as legally they don't have to offer freeze of interest, but eventually be it 1 month, or 3, most creditors will be helpful. I don't know regarding shop direct, not one of mine, but going back to the budget, the info will show that there is no extra for them.
    The process is generally normal dept, then in-house recovery, and eventually external, but at each process stepchange are there to support you. I've had some of mine go through that process and when you see a letter saying "its come to us, pay 2k within 7 days" - one phone call to them saying with stepchange, i will pass the letter to them, and generally I have had no problem.

    I know you mention 6 years, - but things may change, you may find on a review that you don't spend as much on a certain aspect of living expenses and therefore you can increase your payment, as necessary.

    Myself - I tried to self manage for 12 months and I was juggling them all in the air, robbing Peter to pay paul, every creditor thought they were more important than the rest, then I contacted stepchange, I've been with them for 2 years now, and it was the best move i made, yep I had a few phone calls at the start, but all i use to say with Stepchange this is the reference number, (your get all the info when your plan goes live), that reference number was like winning the lottery. After a month, the calls disappeared, i ge the odd letter, usually 6 mothly, when they review the files, - then its one quick call, still with steochange - no problem thank you - done and dusted.

    Sounds strange considering your about to embark on a DMP,
    but with creditors like shop direct, I've always found it better (in the long run) to stop paying altogether, and allow the debt to be sold on to an external DCA, because, as you say, they pile on interest and charges, refuse offers of any lower payments, and generally just make life harder for you.
    That's what I did, and it was a lot easier to deal with when the debt was sold on, not the solution for everyone possibly, because you will be hassled by letters and calls, I was used to dealing with creditors/DCA`s and knew it was all bluster, and was well able to deal with the fallout, not everyone will be though, just thought id give you another option to consider, good luck with whatever you decide to do, don't let them bully you though.

    Hi everyone

    This thread has been set up with the intention of answering specific debt questions and giving support and guidance where needed. The conversation that’s unfolded here isn’t really relevant to what this thread’s about. Having said that, I will try and answer some of the questions that have come up.

    In regards to creditors not being able to produce proof of debt, usually you'd be sent a photocopy of the forms you signed when you took out the credit. It could be that they've got to get in touch with the original creditor and this has caused some sort of delay. I must admit that I've never heard of somebody offering to visit an office in person to see an original agreement. I suspect most debt collectors aren't set up to receive face to face visits from their clients, so that might explain why they've not agreed to that specific request.

    It's not unusual for debt collectors to leave accounts alone for a while. So the current period of inactivity may just be part of the natural cycle debts go through or it could be a reaction to the requests you've made. It's hard to say which of these is happening.

    The answers I've given may sound a bit vague but it's very hard to know what's happening behind the scenes at a debt collection agency. It may be worth giving them a call to discuss what's going on.

    That said, we cannot endorse ignoring a creditor’s correspondence, as doing so can often make a person’s situation more stressful. Our ethos is to deal with your debts as fairly and realistically as possible. Debts should never be avoided deliberately.
