partial refund query-help please

I bought a dress from a business seller, they had them listed as 8-10, 12-14 and 16-18 size wise, I wear a 10 so went for the 8-10 as it looked like a stretchy material too so would have a little give.
it arrived and there was no way is was an 8 let alone 10, more like a 6 if that, I couldnt get it past my shoulders!! And after receiving it I saw feedback that had just been given in the days since I bought it saying same about the sizing on the dress. I hadnt removed the tags, so requested a return, they agreed and I posted tue, they received wed according to the tracking.
Have just had a message saying they have issued me a partial refund, the cost of the dress only and that they dont refund the iniatial postage costs of £3.99 for items that dont fit.
Can they really do this?? They have refunded me £12 for the dress, but i paid £15.98 total, and tbh had the feedback about the sizing been there before I bought it I wouldnt have purchased it in the size I did. Although seeing it when I got it I wouldnt have purchased it at all, didnt look as good as the picture made out.

This is from the Ebay quide for sellers:
Under the Distance Selling Regulations, buyers have a period of 7 working days after the date of delivery within which they can cancel the contract (often referred to as the "cooling off" period) and get their money back, including the original postage and packing charges. You must refund the original delivery charges. However, you are permitted to require the buyer to pay for the cost of returning the item, but only if you clearly inform the buyer of this before the contract is made.0 -
thats what I thought, that I couldnt get the cost of returning the item refunded but that they had to return the whole cost inc postage. thanks for that. I shall send them that and ask for the other £3.97 to be refunded as well. I received the item on the friday and returned it tue cos they didnt respond to the return request for a couple of days and then I had to go to my parents to print out the return slip. x0

Have raised the dispute in paypal and requested the return of the £3.98 that he still owes me for the iniatial postage. I have yet to leave feedback, was thinking of neutral before this, but its def gonna be a neg now.0
