Levaing A rented property

Hi

We started renting a house this year but i have recently been laid off and cannot afford to pay the rent. I spoke to the landlord and informed them come december i will have to move. They agreed to re list it and i would cover the cost of the finder fee. My worry is if they dont find an one to rent it what would be the route i would have to take then.

  • Leaving early: is there a break-clause in your tenancy agreement? What is the fixed-term and when did you sign it?

    You could find that you may not have an automatic right to end the tenancy early. In which case you will have to pay the rent in full until the expiry. If they cannot find a replacement tenant you will also have to pay the rent in full as well.

    Have you applied for LHA from your local authority now that you've been laid off?

    It tells you exactly when you can and can't leave a tenancy!

    Including info on Break clauses, Early Surrender etc!

    You can hardly have read it fully in the time between my posting the link and your reply!

    Welcome as a newbie poster :smiley:

    Is your tenancy still within a Fixed Term? Or has the FT ended and the tenancy is now continuing month to month ( assuming rent paid monthly)?

    If you are still within the FT then, unless your LL agrees otherwise, you have to meet your commitment under the contract to pay rent for the duration of that Fixed Term. Normally this would mean that you continue to pay rent until a new suitable T can be moved in and it is usual for a LL in these circumstances to ask you to pay the reasonable costs for re-advertising etc.

    Ask if you can help with the readvertising and be flexible about viewing times for potential Ts.

    If the tenancy's FT has already finished then you would simply have to give one month's notice to tie in with the "tenancy period", unless your LL agrees otherwise

    As has been said, get written confirmation from the LL of how s/he wants to deal with your need to end the tenancy. Intelligent LLs will aim to get in a new T asap becuase the alternative is that they have a T remaining in the property but unable to pay the rent.

    Have you already checked out alternative accomms for yourself?

    They have agreed to re list the property I said I would cover the finders fee they can just keep my deposit. We are moving out no matter what come next month. It's a fixed term until June next year.
  • If you're still in your fixed-term the landlord has you by the short-and-curlies.

    If they are realistic, and don't necessarily relish the thought of chasing you through the courts for all of the rent until June next year and the expense that would entail, they should be doing everything they can to secure a suitable replacement tenant asap with little to no void-period in between.


    I sincerely hope that that is precisely what they are doing.
