Hi I have split up with my oh, we have 2 children together & he is my carer as i'm disabled.
He said that it's unfair for me to expect him to just move out as he has no money & nowhere to go so want's to stay while he gets a job and saves for a rental deposit.
I claim IB & DLA for myself which is topped up with IS for him as he gets carer's allowance. We also get CTC jointly & I get CHB.
Am I right in thinking that because it's only the IS that's means tested & that will be stopping due to us splitting that it will be ok for him to stay for a couple of months without it effecting my benefits?

Who's going to be your carer when he gets a job or moves out and signs on?
The DWP will almost certainly still view you as a couple until he moves out, so it might be better to keep the claim as a couple claim until that happens *** can anyone else advise here? ***0 -
As above - it may not be technically correct but it certainly seems to be the easiest thing to do.0
