New condition 15.8 LTSB

New Condition 15.8 Hi everyone like many i have received a letter from lloyds TSB,

Now from the past 2 years or so i have had a D.M.P and there had been a lot of charges before this and during, the letter sates.

From the 1st of January 2013 were changing your credit card agreement with us and adding a new condition to your existing terms and conditions.

Its important we tell you about this change as your credit card accounts is currently in default and theres still a balance owing- although you may have a repayment plan in place with us to reduce this we have included the new condition for you to read

If we owe you any money in connection with any transfers, interest or charges on your account we may use that money to reduce any arrears you owe under this agreement. If we intend to do this we will tell you when we offer to make a payment to you. We will also follow any relevant guidance in a Code of Practice that applies to us, as required by our regulator or another similar body.

theres no need to do anything else.

Does this mean my account will be ammended by them when they have worked out what they owe me am alittel confused also i never had ppi on the card but it did inure intrest chareges ect as they stated above in there leter thanks :T

  • Have you made any claim for PPI or other charges?

If so and you are successful then I read it they will credit that against what you owe rather than give you a cheque to do as you please.

If you didn't have ppi on the card, what makes you think they owe you money?

what makes me think that is because of the part of the letter that states, If we owe you any money in connection with any transfers, interest or charges on your account

    hence why i asked ! :)

It says "if we owe you", not "we do owe you".

Probably something that their lawyers havepicked up on, obviously from the ppi issue but they have probably decidd to make this universal to use as a catch all in similar circumstances.

Yes i can read thank you. You still havent said why you think this condition applies to you. You implied that you think they owe you something but havent elaborated as to why. This condition would really only apply if there was an error or fraud on your account resulting in charges and/or interest, or if you had ppi on your account.

They are not about to refund all your interest or charges that you have accumulated, which is what i think, you think this letter means.

The letter says If they owe you any money.... I think that is pretty clear don't you?

It's a generic letter composed to advise all relevant customers of a change to terms and conditions - do you really think they would get someone to individually draft letters to each and every customer?

Seems like this is standard procedure, where they are sending all that have arrears and/or in default with the account.

This is just an informal letter. ;)

From what I know of with others, they have in the past already made a successful claims, so nothing more is owed to them, and the bank still made refunds payable to that account and not the customer, so nothing new really.
