Mis-Advertising Advice please

Hello All,
I'm looking for some advice please.
This week I traded in my old car and purchased a 59 plate Nissan Micra - I added cash to the trade in price of my old car.
Today, I asked my partner to adjust the height of the driver's seat for me, then we found it wasn't adjustable. Fortunately, my partner had taken a picture on his iphone of the advertised details from within the car when we looked round it at the garage - it states adjustable height driver's seat.
We had to take some papers for the old car into the dealership, so we asked them to double check whether the seat was adjustable. They agreed it wasn't and told us to call back in tomorrow to talk to the salesman we had done the deal with. The man we spoke to today said it'd probably be a case of either having the car as it is or handing it back/getting a refund.
So, my question is what should we be looking for regarding this, in order to solve the issue? It is a disappointment that it isn't adjustable as, being about 5ft, it was something I was definitely pleased with bein able to have, equally i've never had this issue before so not entirely sure as to the possible solutions.

They may offer a (small) discount on the price you paid, or if they still have your trade in they may offer to cancel the whole deal and give you your old car back.
Or they may suggest upgrading to a model with an adjustable seat, and suggest some sort of deal for that.

I don't know really - i'd like to keep the car but i do feel rather misled. Personally, we'd like some sort of compensation but no idea what is likely to happen or reasonable in this situation - so any advice would be helpful!0

Ideally I would like an adjustable seat but that would cost them hundreds to sort out i'm assuming, and they probably won't want to?0

Of course, you could have actually checked that the seat was adjustable before you paid for it. If it was that important to your purchase of that particular car.
Presumably you checked that the other functions were working, so why not that one.
As societys child has said. Compensation will not alter the fact that the seat height is not adjustable.I can afford anything that I want.

I'd imagine they'd offer whatever is most cost effective for them. They have offered a refund, it's possible they may offer a discount if you negotiate with them.0 -
Iit has been acknowledged that we could have checked it, infact I did mention it to the Salesman at the time that our other vehicle [the partner's] had that function.
I think it's important to remember that the dealership are the expert on what the cars functions are, it shouldn't be down to me to check their work! It's reasonable to think that you get what you pay for, and should it not have had this specific feature listed, i wouldn't have anticipated it and would have been able to make that informed choice at the time.0 -
I'm a little amazed - it is your money, why should you not take responsibility for your purchase? Clearly if the feature was as important as you make it to be, then that would have been checked before passing any money over.
Incompetence by the dealer is allowed, providing they did not intend to mislead. If they provided a cushion, that would resolve the issue - £10, say?
As a gateway to make the dealership somehow pay for the error, it don't see it happening, other than a goodwill gesture.0 -
Strange OP, and I am not the first to comment.
If I was 5ft, and I purchased a car with an adjustable seat, I'd have asked for a test drive and changed the seat to suit my height.
How did you test drive your new car? Infact, DID you test drive the car, or just take the dealers word for it that it drove?0 -
