Faulty iphone off ebay-options?

Hi guys,wonder if you can give me a bit of advice please.
I bought an iphone 4s off a guy from ebay,this was back at very end of Sept-as the guy was upgrading to an iphone 5 and would not get that until around the 9 Oct he asked if I would mind waiting until he gets it otherwise he would be left without a phone-i wasnt in any hurry so i said no problem,he said he would keep me updated when apple despatch his iphone 5 and when he posts mine to me,which he did.
this was the wording on his listing
I phone 4s 16gb Black on O2, I have had the phone around 8 months, The phone is in excellent condition it has no scratches to the back or screen due to having screen protectors on (back protection is visible in photo). It comes with all accessories,box and unused headphones. The phone is also still in manufacturers warranty for a few more months so should there be any problems you should be able to get it fixed or replaced free of charge at your local apple store.
I am selling due to upgrading to the new I phone 5
i received the iphone as promised on 11 Oct,it was in mint condition as he said.i restored it from a backup i had just done on itunes(i had an iphone 3gs).all seemed fine until i discovered the phone had no sound apart from a ringtone when somebody called you,there was no sound when you received a text,you couldnt hear any music you put on it,hear audio from any video you put on it.i restored the phone a few times and even did a complete set up as a new phone,without putting anything from the backup on it incase something was bad with the backup i did....it was still the same.i emailed the seller via ebay and told him the problem,he said it was very strange as he was using the phone fine up until he packaged it up to send to me,he asked if i had done a clean install and restored the phone,which i had.he said could i goto an apple store and they would sort it free,i said its 100 mile round trip to my nearest one and i bought the phone in good faith and could i return it for a refund(i was fiddling with the phone for nearly 4 hours and had had enough),he said he understood that and it was working fine when he sent it me and it would be a 100 mile trip for him also and for the sake of 100 mile trip i could have a new phone,he then told me that this was a replacement phone for one that went wrong and as the iphone hadnt been out a year there would be no problem getting it replaced free.......,i was off on holiday a few days later so wouldnt have time to get it sorted at the apple store until i got back(last week).
i came back off holiday last week and decided to book an appointment at the apple store genius bar,the soonest i could get an appointment was thursday just gone,i go in thursday,explain the problem,the guy goes through all the checks etc and sees it isnt working properly,upon looking in the bottom of the phone he showed me a little indicator which shows the phone may of suffered from slight moisture damage,but nothing serious and he thought there was some problem with the connector that the phone thinks its in a dock.he asks how old the phone is.i explained i bought the phone off ebay and he said no problem,the warranty comes with the phone not the individual who purchased it.he looked the phone up on his little gadget thing he had round his neck......he then told/showed me that the guy i bought it off had this phone replaced under warranty in Feb of this year,great i thought,thats less than a year,then the apple guy showed me he bought his original 4s on 14 Oct 2011....when you have a replacement from apple the replacement inherits the remaining warranty from the original item you dont get another full year......so it was out of warranty,infact as he sent it me on 11 Oct this year I would of had literally 3 days to get to the apple store to catch it in warranty,it took me 6 days to get the appointment for the thursday,so even if i wasnt going on holiday and made an appointment straight away if i had had to wait 6 days again i would still have been too late......he said he was sorry and told me my only option would be a replacement which they do for £140,they keep the old phone and recycle it,as i needed a phone i saw this as my only option and i paid the £140.......I emailed the seller when i got back on thursday,saying i was not happy at all that i would of had 3 days to get it there to catch the warranty and i had to buy the replacement.......i paid the guy £300 for the phone,apple £140 for the replacement....i could of bought a brand new 4s from apple for £449 with a 12 month warranty.......as yet the guy has not even responded to me......in his position i would of offered the person the £140 back and appologised.......do i have any options at all here with paypal?anyone?even if its to get the £140 back

Nothing you can do now as you don't have his phone to return to him.
You could ask if he would contribute towards the replacement but i wouldn't be expecting anything.0 -
I wouldnt have paid the £140 until I'd spoke to the seller. Then opened an SNAD perhaps.0

All you had to do was open up a "not as described" dispute, return it, and get your money back.
All you can do now is leave a neg, as YOU chose to spend money getting a new one.
Oh, you do have another option - the Sale Of Goods Act trumps a warranty, so you could tell Apple that an iphone should last more than 1 year, so you want it fixed for free!Should've = Should HAVE (not 'of')

You could have got a full refund from the seller if you still had the phone.
Why didnt you ask for advice before now?
Now that you no longer have the phone there is nothing you can do about it.0 -
After restoring the iphone you should plug in the ear phones and take them out again and it should work0
