I KNOW i personally feel that we were persuaded to take out ppi against our wishes, However if the strength of their paperwork i.e our signature means we should not persue then I would not persue it but still feel that they have been unfair to us.
How you proceed now is up to you, I'm just pointing out that you have a very uphill (and long) struggle ahead if you decide to refer this to FOS.

Did you take you have single premium PPI or was it a standalone payment taken out separately for the PPI alone?

Because I've just thought that if they refunded the first loans PPI, then logically, they should have refunded the second f it was sold in the same way [in the bank with an advisor/sales assisstant] unless the circumstances were completely different either in the selling or your own circumstances.

Ok so this gets more confusing to me, We have managed to work out that our £15k loan was paid in 2 ways £8k was paid into hfc account A which was used to pay other existing debts ie credit cards/ bike loan etc and the other £7k was paid into our household account.
We still don't fully understand the situation with account A but have on acc B (missold ppi claim account) my partner has single life cover.............i'm having trouble understanding how I claimed misselling on account B and got refused but they have agreed to uphold part of account A that I didn't claim for and most certainly wouldn't have claimed the ppi on acc A was missold if I wasn't even aware of this account.

it's very missleading that they open accounts for you to put the money in from the loan that they give you.

You must have agreed to (or even requested) this arrangement otherwise it would not have been set up that way.

While I can see how you find your own bank account confusing, I don't see how you can claim it is in any way misleading. Everything you've detailed here seems completely transparent.

    You're confusing yourself.

Your 15k loan was split between 2 accounts. These are not 2 separate loans, they are 7k and 8k split between two bank accounts.

The loan you got a refund for PPI on, was the first loan, and completely separate from the 15k loan.

the 15k loan paid off this first loan. The complaint on the first loan was upheld, so you had a refund.

The complaint on the second loan, the 15k loan, has not been upheld.

Or at least that's how I understand your posts.....

  • Yup i'll agree with you that i'm confusing myself and probably other people lol, I don't mean to do that and appreciate all the responses so far.

We signed the ppi agreement and we were aware that we were signing the ppi agreement, We went through the cooling off period knowing that we were getting into the ppi agreement however we were told from the off that if we did not accept the ppi agreement that we stood no change of getting the loan.

Yes we should have been a little more astute but we were not as concious of our finances then and I was certainly not used to shopping round or finding out more info before going ahead with such an important financial decision as I am now BUT the situation still remains that were would NOT have got ppi if we were not told that without it we would be turned down by the underwriters or we would stand a better chance if we had it.

Again thanks all for your help, I'll keep an eye on the thread in case anyone else can add to it.

yes, we know you bought it because you felt like you had to have it.
Trouble is, that doesn't make for a reason that anyone can prove.

You need to look for things that can be proved, like single premium, or because you were self-employed, or an existing illness.
