wescot chasing me for old loan....

ok, here is the story, it involves some stupidity on my part. Just a warning.

about 4 years ago, my ex took a loan for 10k out in my name at llyods tsb (ive no idea how as i thought you needed a signature to get a loan of that amount?) . she told me her dad had put that sum of money in my account and it was for her so i withdrew it and give it to her.

anyway, so many months later i got letter demanding money for a LOAN etc. i put in a complaint and a fraud claim at the branch, i continued getting letters with the amount going up and up so i stared making some payments as i was scared about all the interest . anyway i pestered llyods for over 18 months about this being fraud and they said they were still looking into it! i even paid off around 7k-8k in that time leaving me just 4k to pay. i was expecting this to be returned when they confirmed there was no signature.

anyway i stopped paying as i hated paying for something i shouldnt and they were clearly lying about looking into my claims.

it got passed over to wescot a while ago and ive discussed it with them saying i wasnt liable for the loan but the reassure had me depressed and i was considering paying to make it go away.

and for some reason they are asking for 7k :-S. what should i do i pretty confused here? should i refuse to pay it until they provide a signature/proof that its mine? just ignore? help :(

    How did she apply for the loan? Did you report her to the police?

    As you have been making the repayments on the loan, and as you withdrew the money from your account, it will be difficult to argue that you are not liable for it. As for the £7K figure, there will be a great amount of interest payable due to you having ignored it for so long - you should ask for a breakdown of the figure to ensure it is correct.

    hi, i've no idea they have yet to tell me after 2 years of asking

    i reported it to the police yes, they give me a crime number but sid get back to them once the bank comes to a conclusion with their investigation

    Your problem is that you did not chase them up on this complaint. This, combined with the fact that you acknowledged the debt as yours for so long, leads me to conclude that you remain liable for it.

    Is this the same thread that you offered a full and final settlement on a while back? If so, again you have confirmed that the debt is yours.

    i have chased them up maybe 20-30 times, they still didnt help me.

    yeah i offered a full and final but in every letter i stated i did not take loan out, i assume this will make no differance.

    last time i was on here i dont believe wescot were involved, what would happen if i asked them to prove that i was liable?

    Put everything in writing and then you have a copy...use the official complaints procedure...Why would you not question how it ended up in your account? To me you have been part of the story by not asking sensible questions of her and the bank...
    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    I can only think that she may have made the application online, but that would mean she would have needed to know your full internet banking details.

    OP if you haven't already done so, you need to change those.

    Other than that, pursue the complaints process and do it all in writing, signed for.

    Just send the "prove it" letter as it is just speculation at this point.
  • Hi, if you still have the police ref no pass it onto wescot, they will refer it back to tsb with this information (I used to work for them), you really didn't need to pay any of it.

    Nor me, when a friend deposits money into my bank account my statement clearly tells me who put it there.

    I find it a tad unbelievable someone has repaid so much of a disputed debt. Not a cat in hells chance I would have repaid a penny toward it.

    What happened to the £10k in any case? Did she leg it or did you benefit from it?
