Hi All
I wrote to halifax about 2 weeks ago requesting mine and my OH joint bank account be closed in preperation for my bankruptcy hearing this Monday. There is an overdraft on the account which I requested a bill be sent to my husband for the amount; the letter had both of our sigs on it and there is an overdraft which I requested a bill for this amount be sent to my husband, however as yet the account remains open and I am getting a little concerned. If this account is not closed by Monday what will happen to my OH credit file when I go bankrupt? Really dont want to put off bankruptcy at this point, any advise?
Thanks

Is there any reason why your OH can't just pay off the overdraft? If he went into a branch to do it he could also close the account at the same time provided he has your signed agreement to do so.....Practically Perfect in Every Way......:grinheart0

You best off do this.
If it is not closed and he is linked to you then it will upset his credit rating.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -
I think it very very unlikely (would like to be wrong) that the bank will agree to closing the account and then billing one party for the OD.
If he does pay off the OD before the BR date, then make sure that he does it in a way that the funds are clearly traceable to him rather than you. No way will the bank close the account whilst there is still a sum outstanding........though I wonder if they would transfer the overdraft sum to the OH's other account and then close it? He'd have to be with the same bank though.

Just we both work so much he wont have time to go before my hearing Monday. How bad will it effect his credit score, short term or long term like bankruptcy?0

When I split with my xh he merely took in forms which I had signed agreeing/requesting my name to be taken off the accounts and the banks accepted that fine even though there were overdrafts. Lunchtime? Internet banking? Telephone banking?
If you still have a joint account your bankruptcy WILL be horrible for his credit rating. Sort it out today. You have left this too long already.....it is the most important thing you have to do today.....Practically Perfect in Every Way......:grinheart0 -
Thanks Guys
Think im just going to have to re-schedule, just dont have the money for the overdraft and bankruptcy, it will be at least another 3 weeks before we can pay the overdraft after saving for my bankruptcy fees.
Anyone know how long it will effect his credit for if I went ahead, 6 months, 1 year, the whole of my bankruptcy term???? I just really dont want to have to put it off a minute longer now the decision is made.0 -
6 years from the date of bankruptcy. Sorry you do need to make sure that any joint accounts are closed and that you make sure that you dissacociate yourself from him with all three credit reference agency's. This can take a month or so, so your best bet is to hold off untill you sort this and it will give you time to save up.

Joint accounts don't need to be closed, you just need to get them made into a single account and get your name taken off them. If both you and he agree then that shouldn't be a problem."Our prime purpose in this life is to help others. And if you can't help them, at least don't hurt them." Dalai Lama0
