Aviva car insurance claim reopened

I was with Aviva for a year, not any more. I had an accident earlier this year and it was the 3rd party at fault. Although the 3rd party contested it, eventually it was proved they were at fault and I got a pay out and my full excess back from 3rd party. The matter was closed. Now Aviva are saying they reopened the case and now I'm at fault! Which has put my premium up and lost my no claims and so I am waiting to fight off Aviva and find out why on earth they reopened my claim. I go through an insurance broker and they are my go between and say it'll take 2 weeks. Where do I stand legally and what do I do?

    Call Aviva direct and ask?
  • I go through my insurance broker and they are dealing with it, but seem slow. I may eventually have to contact Aviva directly. Any advice would be great!!!

    All you can do is see what has come to light to reverse the decision and take it from there.

    If you end up being held fully liable then be prepared for having to repay your excess together with any other uninsured losses if you have claimed those off the third party.
  • Personally would call my insurers directly rather than having chinese whispers with using the broker as a messaging service. If you cant resolve the matter directly then call in the help of the broker.

    In many claims systems all open claims count as "fault" and so this isnt automatically an issue or problem. Likewise insurers sometimes receive late invoices which require cases to be reopened to allow them to be paid. How did you find out about the fact it had been reopened in the first case?

  • As I say, it isnt necessarily something terrible thats happened, you need to wait until further information is available or call the insurers directly yourself.

    "At fault" in insurance means your insurer has not recovered all their costs (not necessarily you have been found to 'blame').

    As previously advised you need to find out what the issue is then take it from there.

    If your renewal is due and you want to change insurer then explain the circs to your chosen company and get them to agree that if you get your ncd back when the matter is closed they will amend your premium and refund you any overpayment.
