  • The 'Trustee' terminology in wills can be confusing but needn't be.

    (1) General use of 'Trustee' in a straightforward will: I understand that the person appoints 'executors' to carry out their instructions as regards their estate, and the executors are also, in effect, 'trustees' (trusted holders) of the assets prior to distributing them according to the will. This doesn't mean that complicated Trusts are set up during the process of administering a straightforward will. Normally assets would be held and passed through an 'executors bank account'.

    (2) However, in a specific sense, there may be occasions where specific Trusts (holding money or property, on behalf of someone else, over a longer period) may need to be set up, and the people responsible for such Trusts are called Trustees. This might happen where a minor has to have money held for them in a Trust until they are, say, aged 18.

    It's possible that the will you are dealing with is using the term Trustee in either or both of these senses. I know nothing about Trusts so others will need to advise you here.

    It may also be helpful to state what the will says about the bequest to your daughter, as this MAY be the one where an actual Trust is required..

    Everything directly related to death is supposed to be here, but people post in the wrong place since this board is quite new.

    If you want to bookmark a thread so you can find it again look at the top of all the posts for where it say 'thread tools' then use the 'subscribe to this thread' button. Then you can find the thread in your 'subscribed threads' folder which you get to by clicking 'User CP' which is at the top left in line with the picture of the four members of the forum team.

    Also if you want to find youw own posts, find any thread you have posted on, click on your own username and a drop down menu appears. Click on 'find more posts by Jo101'.

    Which? do some good books - "What to do when someone dies" and "Wills and Probate".

    If you borrow them from the library, make sure the editions are the latest ones otherwise the figures given may be wrong.
