Dear users,

A few years ago I was waiting a set of traffic light when this guy got out his car and asks me why I pulled up so close behind him (I did not). Anyway, I recently got a phone call from my ex-insurance provider (I used to be with AXA motor insurance) and apparently this schmuck has made a claim.

Any ideas? This guy has lied and I do not know what to do. CCTV?

Surely he should have made a claim much earlier? Or have they been trying to contact you for some time?
Isn't it his word against yours?

  • AXA sent me an email saying that apparently they've been trying to get hold of me (why didn't they write to me regarding this?)

Couldn't you just deny all knowledge? If you didn't hit his car you're not lying in denying it are you. Has he got any evidence?

    Just tell the truth.
    And stick to it.
  • How long ago?

Also, he who asserts must prove - so I agree with tattycath
  • Thanks for the comments all. Now I have an idea on how to proceed.

This issue highlights that third parties have 6 years to make a claim against another for damage.

So if you change insurer each year, keep your insurance details on file at least 6 years as the insurer at the time of the incident is the one responsible, and the only one to pass on the claim to (ie the insurer at the time the claim is made won't help if a different company now provides cover!)

To the op: Can you keep us informed about any future developments? I want to know how Axa deals with this.
